Most of the IVans have given good suggestions though no one is a pro on domestic violence case. We are not in stone age - Personally, I dont like any kind of violence against women including the people who does. I think you should get a good attorney, prove that you are innocent and move on.

I have a feeling that they will HAVE To process EAD's in 90 days( that's what the current rule says ) or reinstate the Interim EAD's - terminating Interim EAD seems like the dumbest move they ever made. If either of these doesn't happen, lawsuits are sure to follow. So, don't worry too much about it my friend.
Please see in the USCIS web site that you have to apply 6 months in advance if you are renewing EAD. With so many I485s, EADs, APs flooding the Service centers, you need to apply the EAD now if you want to use it after 6 months from now.

what do you mean by fake pay stubs, can you please clarify.
I am in process of generating pay stubs for my wife by paying the employer tax...so that she is covered for the un paid H1 period.
Why will this cause problem

While IV is already on the major Restrictionists (NumbersUSA, FAIR, CIS.org etc) Radar, it is now being followed by smaller, single issue restrictionist organizations like the Anti-h1b Zazona. Ever wonder why Mr. Sanchez of Zazona targets only Legal Immigrants - people who've always followed the rules laid down by their US lawmakers- like us, instead of illegals??
Perhaps Mr. Sanchez can answer that one next time he visits this website..:)

Subject: H-1Bs go to K Street
------------------------<<<>>>------------------------
JOB DESTRUCTION NEWSLETTER
by Rob Sanchez
April 26, 2006 No. 1466
------------------------<<<>>>------------------------
A new organization of called Immigration Voice (IV) has been formed to
lobby the U.S. government. Most of the members are foreign nationals on
H-1B visas. They want the U.S. government to issue more green cards so that
H-1Bs can gain permanent residency. Immigration Voice seems to be a single
issue advocacy group because they don't mention H-1B, however, they are
supporting the Specter bill in the Senate that has a massive increase in
Green Card visas as well as H-1B and a new visa called F-4.
H-1B is a temporary visa that can last for up to six years, but due to a
new 7th Year Extension rule visas can be renewed indefinitely until the
visa holder obtains a green card. As long as the green card application is
in the cue the H-1B can stay. There are limits to the number of green cards
issued per year, and that is what IV wants to change. As Dr. Philip Martin
from UCDavis wrote, "There Is Nothing More Permanent Than Temporary Foreign
Workers." To read Martin's classic paper go to:
http://www.cis.org/articles/2001/back501.html
The stated goal from their website:
http://immigrationvoice.org/
Our big initiative currently is towards addressing delays
and other flaws in the employment based green card process.
Immigration Voice formed very quickly and they are showing that they are
very serious about lobbying the U.S. government. They hired a professional
lobbying firm to represent them called Quinn Gillespie & Associates LLC. IV
also is talking with the infamous lobbyist Rick Swartz. Norman Matloff
described Swartz as a "pro-immigration lobbying kingpin who has represented
both industry firms such as Microsoft and also the ISN". Mark Krikorian at
CIS is usually low key, but not when he wrote about Rick Swartz:
http://www.cis.org/articles/2004/markoped033104.html
And then there's the National Immigration Forum, the umbrella
organization for high-immigration political advocacy, which
works closely with sympathetic Republicans. But NIF is not like
the conventional lobbying coalitions that exist on numerous
issues. It was cofounded by the National Lawyers Guild in the
1980s, back when the Guild was a Soviet front group. The group's
first head was Rick Swartz, a leftist attorney who cut his teeth
advocating for Haitian illegal aliens and who, during a 1981
Senate hearing, likened the United States to Nazi Germany.
Most of the Immigration Voice activities seem to center around fund raising
to pay for their lobbying efforts. They aren't talking about chump change
either. Here are their contributions so far, which must be reported since
they are applying for 501-C(4) status.

When I started reading the Washington Post article below the first question
that came to my mind was the legality of H-1Bs and other foreign nationals
to actively lobby our government. The DOJ answers that very definitively:
http://www.usdoj.gov/criminal/fara/q_A.htm
Foreign Agents Registration Act
Q. Does the Act limit an agent's lobbying and publishing
informational materials (propaganda) for a Foreign
principal?
A. No, the Act requires only registration.
The article below is written by Mitra Kalita. She was born in the U.S. by
parents who immigrated to the U.S. from India. Her bio can be read here:
http://www.pbs.org/searching/aaw_mkalita.html
Kalita does a good job of reporting what Immigration Voice is all about but
the article is not objective, and therefore should be considered lousy
journalism. It's a rather long article with quotes from many advocates for
increasing immigration but not one sentence from somebody that disagrees
with the IV agenda. This statement about IV's quest for more green cards
for H-1B visa holders goes totally unchallenged:
"This is a sympathetic story," said Nick Maduros, a lobbyist
for Quinn Gillespie. "For this group, their issues are very
technical and are frankly not that controversial, but they
have been overshadowed ."
>>>>> THE BIG QUESTION <<<<<
Immigration Voice raises many questions but one stands up in my mind as the
most important:
WHY AFTER 16 YEARS OF H-1B HAVE AMERICAN WORKERS FAILED TO ORGANIZE
THEMSELVES TO FIGHT FOR THEIR JOBS?
There have been many attempts at forming organizations but all of them are
struggling. In all their years of existence they haven't been able to raise
even a fraction of the money IV has raised in just four months. ZaZona.com
as well as many others are operating on such small shoestring budgets we
are continually struggling just to survive.
Why do citizens of the United States lack the passion we are seeing from
foreign nationals that are here both legally and illegally?
One thing for sure, we shouldn't waste time griping about Immigration Voice
because they are playing the political game according to our own rules. If
we lose this one, who's fault is it?
Perhaps Mr. Sanchez can answer that one next time he visits this website..:)

See link to senate rule (particularly, Rule No. 4).
http://rules.senate.gov/senaterules/rule16.php
Cornyn's amendment is "general legislation" seeking to amend an "appropriations bill". To be able to vote on Cornyn's amendment, 60 Senators have to vote to waive Rule No. 4. Only then can the senate vote on Cornyn's "general legislation".
Sorry to flog a dead horse but the Dems should not be blamed; if they had voted to waive the Rule, then all sorts of general amendments would have been offered by others and tough to cast aside.
On the other hand, it is useful to know that more than a handful repubs support this amendment; this could be handy in an actual vote when Sessions or his ilk seeks to filibuster the amendment. We may have 60 votes to win cloture.

Very sorry to hear this and our prayers are with you...hopefully all this will be settled soon and to your satisfaction.
First thing - try not to stress out about this. Really, your baby's health and your own are far more important than some stupid GC. Keep in mind that the less you stress yourself, the more likely the child birth will go peacefully and well.
Secondly, hire a good lawyer - it is well worth the expense and helps relieve your stress.
Thirdly, if possible, let someone else (such as your husband) drive the "discrimination" lawsuit if you think it is fit...helps give you some line of defense against the problem.
Regarding insurance, the employer must offer you COBRA. Also, not all insurance companies consider (or are allowed to consider) pregnancy as a pre-existing condition.
Keep the good focus in mind - let not this affect your baby. And at the same time, don't leave any option unexplored. There're plenty of suggestions in this thread. Ask your lawyer which ones you must explore...
And GOOD LUCK to you and your family! All will be well!

Bad for consulting companies (no H1B; may lose job)
Bad for physicians (no H1B for medical residents; no provisions for NIW...terrible)
Bad for H1b transfers and extensions (severe restrictive provisions on H1B)
AC 21 repealed (disastrous)
Bad for pending I 140 .... left in limbo
Bad for pending LC .... left in complete limbo
Bad for retrogressed.... backlog will increase phenomenally 'cos of decreased visa numbers
This bill is a massive attack on us; we should put all our efforts to oppose and kill the bill. There is little chance that we can get amendments to reverse the potential damage that this bill can do... that is disaster for us.

both seem to be happening at the same time.
The dollar has fallen in comparison to other currencies such as the Pound/Yen/Euro mainly because of some poor economic indicators and worries about another recession etc. At the same time the Indian economy has been growing at breakneck speed causing rupee appreciation. I think both of these things will continue for a while with the Rupee hitting atleast 38 against the dollar.
This is mixed news for the economy I guess. IT outsourcing will hurt since its now more expensive for US customers, but on the other hand things like importing oil are easier for India.
To all those who think India will only do backoffice stuff, I think the next 3-5 years will bring about a sea change in this. Good work has been moved to India, and people are motivated to innovate and do new things. Things have always been more competitive in India (think IIT-JEE exams!!) and it does not take long for some of these folks to realize that they can start their own companies and come out with their own products. The market in India is also maturing to the point where it becomes a substantial consumer of hi-tech products. recent articles about the use of RFID and WiMax point to this. Also, VC interest has always been high in India, all the ingredients for a flood of startups are there, if only IISc in bangalore starts to incubate projects the way Stanford does here in the valley.

This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.
85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.
What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.
The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.
Absolutely true, It is torturing the kids for the aspirations of the parents to be seen in the national TV and for award.
It is not the poor kids are not getting the award, it is the parent, especially it is the trend with indians.

I agree, I was so upset when I read it... Thank you Logiclife for bringing that to our notice.
I just wrote an email to the editors with the email address provided by walking_dude. My email says this:
Dear Editor
You mention in an article dated today that "HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers". And in the same breath you say that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship." Do you know the difference between highly skilled legal immigrants and illegal immigrants?. Why do you have to imply that all highly skilled are illegal, infact 99.99% of highly skilled workers (Tech workers) came to the USA legally and continue to live legally. They are here at the behest of their employers.
So please correct your article to reflect that.

Thanks red200,
There was no RFE at all . Infact I was following up my case through my congressman's office and we always got responce back from uscis saying it is under "Security review" .
The email says "application denied." if it says RFE , I would not have such a shock .
it was reall gard day for me y'day when I sow that . I was almost on the werge of closing a house deal this month and with this 485 issue , I don' think I want to take the risk of buying the house now.
Though I do have little bit hope if it is because 140 revoke and we can prove the AC21 documents , it will get through .
Thanks
vinod
If this is real I hope things work out for you. But this post looks suspicious for the following reasons.
1. A congressman has been contacted but the I485 rejection details have not been received yet.
2. No details about the attorney opinion are provided.
3. Words are mispelt in way that appears deliberate "sow" "werge" and done so consistently. Overall english is good but some anti feels indians have poor spelling.
4. New account just to post this. Poster discovered IV after so many years. Possible but ...
We need to be aware that anti's turn up here and post personal looking details like trouble at POE, RFE , denials to create FUD. This post looks suspiciously like one of those. The OP does not look agitated enough and basically is just telling us "Vinod" used AC21 and got rejected. He is unwilling to give more details in his profile but telling us his name is Vinod.
Again if I an reading too much into this I am sorry.

I was in such a contract when i came to the US, and i left the company when i wanted to.These types of contracts don't hold in the court of law (How can they say that the white collar slavery is legal). The only thing which holds is the Non Compete Clause (If you join the Client Directly, in case of a consultancy firm)...
I do not know the exact wording of your contract , and i am not a lawyer. These are my personal views, and do not constitute a legal advice.

Senior guys, if you don't like a thread, ignore it, the thread may be of interest to some people on the forum. So let those people talk. Also since nothing is happening on the immigration, what else public will do other than 'Time pass'???
