Is this article a systematic effort on the part of CNN to propagandize the Dobbs doctrine of immigrant bashing?
We rallied and marched for relief from the permanent residency process (green cards as you call them) and not for an increase in H1B.

In my husband's case we dont have that much time.
Here what our plan is:-
1. Self file G-28.
2. Follow up with an infopass appt. with in a month.
Rest god willing. What ever is going to happen will happen. No one can stop it from happening.

Yes...we need to get the unused visa numbers. But this is not the right time for that. Because of the economy there will be huge outcry and we should avoid the negative publicity.
In this situation if things are not going bad for us, we should be happy. At least for status quo rather than losing what we have.

I guess if you are assigned a visa number, they may put your case as pending new 140 approval. Ammendment may not take much time. So keep fingers crossed. Good Luck.

Is it possible they are trying to adjudicate my 485. I am EB2 India PD: JAN 2006.
The reason there is an RFE and not a NOID means USCIS is trying to adjudicate your application. Depends what action they take on your response..my 2 cents

GC, I know you feel like everyone is picking on you but you have to understand its hard for some of us to believe such a thing could happen. A friend's friend story doesn't help either. I do believe you had the best intention in posting this so that people who are traveling can be aware of a potential hassle and be prepared to answer questions.
Now we can eliminate all the guessing and skepticism by just calling your friend and asking for the details of the person who was sent back. If you don't have the time send me a PM with your and your friends email ID and I will followup with him to find out what really happened. Think of it as a fact finding mission and I will help you anyway I can to get to the bottom of this and it will also help a lot of the people here to understand the real situation. Would you be willing to help?

I'm getting confused on the date part after reading various posts.
Is it mandatory to wait for 180 days after I140 to port your PD from an old I140 to a new I140(with a different company) ?
To change jobs and continue the same GC process I believe one has to complete at-least 1180 days in I485 stage. However in this stage the new job title and responsibilities should be same
I guess Employer cannot revoke I-140 after 180 days - You may want to check with Immigration Specialist/lawyer

Hi All, This could happen in a border state. Look, there is no need to get hyped up about this. It is my 12 year of living in a border state ( the northern border). First lived 12 miles frin the border, now about 75 miles. We have never faced this problem, neither has any one of at-least a few dozen people that I know.
Maybe the CBP had some specific information about a vehicle carrying some person(s) of interest to the US government or CBP, or some vehicle carrying contraband.
Anyways, my point is, there is simple solution to this issue. Make clear (colored, if possible)) photocopies of your and your family's passport front page, Visa page and I-94 cards and keep those in each of your vehicle's glovebox. I am sure, these along with a Driver's License will be enough to convince all but the stupidest CBP officer.
For those, who have EAD, carry it with you That simple.

Can anyone confirm if the files are actually being transferred from Nebraska to Texas? Why is the compliance date for Texas 10/26 and for Nebraska it's 8/1.
Why would files be transferred from NSC to TSC. Didn't USCIS issue instructions to file everything at NSC. Life is getting more complicated each day.

Lord almighty people are getting really carried away. :) This cutoff setting guy hadn't even made up his mind as of Feb 13. Also read my entire post, he won't set the date till he sees the estimate from USCIS.
Btw, my PD is Jan 03 and my LUD is still back in November 07 (when my attorney changed).
Most likely he'll see how much the demand really is and decide a cutoff at early 2002 or maybe even 2001. Remember EB-2 india vanished even after cutoff being at Jan 2000.

I think this is a brilliant idea and might even fly esp because it still preserves USCIS/DOS EB caste system while providin some relief to the EB3s.
While porting is still an option, it is in EB3 filers' interest to push forward on this idea.
I feel frustrated at some peoples' unwillingness to admit that EB3 needs IV's help now more than ever. They are saying that nothing much can be done for EB3, as INS merely corrected its wrong interpretation in visa allocation
But, if we are all willing to put our hearts and minds to it we can surely come up with new ideas that will help our cause. Surely, laws are written so that justice can happen. So if justice is not happening, the law would have some answer, somewhere.
Let me put forward my idea.
The INA language says that until EB2 is not current, there will be no spillover to EB3. Agreed. But I would contend that this statement is on a year to year basis. That is, if in the year 2002 (for example) all EB2 has been satisfied, then the spillovers should go to year 2002 EB3.

Let us go back to 10,000 B.C or further back (ice age or if possible even before).
Was there any gods (known to us) then (any religion for that matter)?
Gods came in to existence with human civilization. Initially as an answer to all things that were 'unknown' to human beings and then later as a 'tool' to insist discipline (in their own understanding as to what discipline is) among human beings.
We talk about Iran, Iraq, afghanistan wars, bomb blasts in India, poverty in places like somalia and in all of these INCIDENTS millions of innocents died/die. What are/were the 'Gods' doing? Can They not stop this from happening?
They won't. Because these are started by human beings and unless we stop it won't stop. Now don't direct me to a book or a PDF. Answer me straight.
Human beings are the most cruel/selfish creatures on earth. We are animals - well worse than them - social animals. This thread does not make any sense.
We are talking about our 'beliefs' here and that is decided by so many factors. Million people will have million different beliefs.

I totally agree with your attitude and thinking. There is nothing wrong to request this issue to USCIS. It won't hurt us ! They will realize the magnitude of the issue and may do something to convinse the lawmakers.
We should definietly try this,even if the outcome may be failure !

After arriving in US , typically It takes about a year or two before you start ur GC process.(Initial job/city jumping )
So most of the applicants in 01-02 arrived during the halcyon days of 99-00.

It is such irresponsible advise that has made EB2 India unavailable. The EB2 or eb3 should be decided based on the job requirements and not to fulfill your personal needs so that you can jump from eb3 to eb2. have you heard the adage "One rotten apple spoils the whole barrel". it is basically because of people like you the whole EB system is tainted and viewed as filled with corrupt people who will bend rules to suit there needs. Forget eb2 go for eb1 but only if your job really is in EB1 and not to cheat the system. You may get away with it but the end result is DOL and USCIS will make it stringent to get eb2 or eb1.
anyway the practical matter is people ported from eb3 to eb2 recklessly and eb2 is becoming same as eb3.
if u can keep thd same PD whenu change from eB3 to eB2..you should do it immediately!
