I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. i really appreciate and applaud what you and other members of immigration voice and other pro-imigration groups have done but for personal reasons i believe that fighting the congress is a losing battle and i sincerely doubt if we'll have any pro-immigration bill passed before the 2008 presidential election and when the new president comes this will fall att the bottom of his/her agenda. Look at Bush's tenure he's promised pro-immigration measures since 2004 and squat has happened. The issue is that there a lot of anti- legal and illegal immigration activists and congress members who will make sure nothing goes thru the senate or the house.

By "those people" I mean the people that come to the forums only to either track which mail room boy signed for a package, or argue about who bad the inactivity of movement on a Priority Date movement would be.
"Those people" are not here to contribute, they aren't here to help anyway. They aren't interested in meeting their lawmakers, or attending a rally.
In all honesty, "those people", who are busy tracking not predicting probably don't give 2 hoots about bulletins anymore, they are content with 10 years of EAD / AP renewals but doing nothing to change that.

Why cant you guys understand, we have no right to demand.
Lot of people , who otherwise would have qualified for Eb2 went ahead with EB3. First of all why did you you agree to it. Because, that time, that was something easy to get instead of changing it to EB2. That was the fight under your control. Not the one you are asking for.
Someone rightly said, you need one scientist,2 qualified/experience guys and 6 eb3 guys to do actual work. A right pyramid for an organisation.
But how can you miss govt. requirement. They need more PhDs. So they are asking us to do more study, earn more higher advanced degrees because thats what they need. Not our so called BE/Btech degree. In another 4-5 years, I wont be surprised, if only guys with masters will be only allowed to apply, if they find equal number of master graduates. Who cares for ordinary graduates. EB3 min qual will be raised to Masters with 5 years experience. What will be your say then ?
So look ahead and act accordingly. Make sure you can anticpate their moves. Its not a rocket science. 6-7 years back, there wasnt much application for EB category. But looking at the last year number, I wont be suprised, if they decide to raise the criteria bar. Simple, and all backlogs will be over. The reason they are not doing this because they still need eb3/eb2. But not in quantity, you would like them to but rather what they would like to have.
As far as country uota is concerned, everyone knows China and India, over populous contry. You increase the number to a million, and that would also fall short. But then they do not want so many people from a single country, as it will have a lot of political ramification in the future.
You are making up things here; Eb1->Eb2->Eb3 is correct only from education and experience for the Job point of view but not true from Quota point of view.
�The argument that Eb1 is preferred above Eb2 and BE2 is preferred over EB3 is absurd.
The regular yearly BE quota is distributed equally among all three categories, so then why they should not follow the same distribution for the overflow numbers?
Said that all BE3 applicants who are eligible should port there PD to EB2. Simple, when you know how the system works try to adapt to it.�
We don�t know the system when we filed our CGs, we just trusted out attorneys. If we have to do this CG stuff again most of us will do it differently.
Remember one more thing, one may be EB2 can still be less qualified and less experienced then an EB3 as EB criteria is for the Job not for the person.

Should watch AILA's stand on this. One group who would benefit immensely with this system would be immi lawyers, at least for first 10 years after which it would be more established. A perfectly intelligent delaying technique moving the issue away from its solution at least by 2 full years. This idea appears to be so full of holes, it seems as though coming from WH itself. Soemtime Logiclife nicely argued against such a suggestion, it would help to dig out those comments and post them here...
on the contrary, the point based system completely eliminates the need of a lawyer, with the canadian and australian system u just need to do the work urself online and the balls starts rolling then, it'll be interesting how they react to this

How can you judge God's intentions when you don't know Him? Can you prove that God does not exist?

All,
The object of this thread is straightforward - it is to understand if you as a donor member will contribute more $ (or start contributing!) if you get more regular information updates (weekly?) from Core? I know there was a funding drive in March which led to us meeting the goal of $10,000 (and then some). However, while there has been a new goal of $10,000 created for April, we have made little progress towards that. As someone who contributed $100 the first time round in March, but haven't yet made a contribution towards the April funding drive, I can admit that one of the primary reasons for this is because there has been very limited information shared since then. While I COMPLETELY trust in the fact that the Core team is making every effort humanly possible to further our cause, I am also a member of the human race that by nature seeks information and looks for leadership to be more sharing about progress. I personally believe transparency is a key enabler not just to gaining participation and building momentum, but also to creating innovative solutions to problems by engaging more individuals in the process (borrowing this "leaf" from President's Obama's playbook will be highly beneficial to our casuse)
Let me clarify this is NOT an indication of lack of trust in Core NOR do I believe that there isn't a sincere effort being put in by a whole bunch of dedicated individuals. However, my suggestion is simply an idea to further the cause - would definitely like to hear how the rest of this immigration community feels!

I hope it does some good to you and makes your PD current/closer so that you dont eat/sleep/drink VB. C mon man... There are other things you can do. Dont get offended by what I am saying. If your PD is closer, I can understand your excitement. But a lot of people are just killing time in forums by working their ass off on predictions and call it comic relief. I hope IV core members stop encouraging this kind of behavior.

As a temporary measure you could have them apply for visitor visas.
Both my parents got approved for 10 year visitor visas...it allows them to stay here 6 months at a time...they just need to go back every 5 and 1/2 months to ensure they don't overstay the 6 months. This way they can stay with you most of the year.
Ofcourse if they are too old this may not be feasible as flying 21+ hours is no joke

I think flowers comaign is a good idea. But I wanted to know why don't we send letters and emails to Mr.Aytes and USCIS Director and probably HEads of DOS to issue the 182,000 unused visas since 2000 now so USCIS can work on those visas from July to October.
NYTimes article mentioned that DOS officials did not want this years number wasted like the 182,000 visas got unused since 2000.
Can someone come up with a writing so we can all send emails and postals mails with this request.
They need a mandate from the congress to do it, once in the past, during the clinton administration, they got the "GO" to use up unused visas.
The current administration dosent want to do that, that is exactly why we need more awareness in the media and the congress.

No vkkkk, I'm not playing. What some people are saying is logic and what i'm saying is the fact. You seems new in this form. But i think most of the people here are serious and try share their sufferings, free help from freinds (virtual).
Anyway, My lawyer used the PERM. right after i received my Labor (may 2006) I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application. I didn't even bother to use the premium processing for my i140 because the i485 was not current that time, instead it way way back as a EB3. anyway, you know the rest of the story.....

if u know any indian grocery near by they deal money also . u can pay the money to thier people in india & they will give it here taking 1 or 2% commission . but u should know the people , otherwise they will cheat

Applied for AP on June 1 at NSC. NO LUD changes till about last week.
I contacted USCIS and had an expedite request put in. Worked with USCIS ombudsman to figure out what was happening. Worked with my State Senator's office to put some heat on USCIS. After all the above efforts, finally got mine & My spouse's AP approved yesterday.(Oct 13). Total of 134 long days since i applied for my AP.
NSC is notorious for being late and lackadaiscal. I advice ppl to step in and take your cases to Ombudsman & Senators. They tend to be lot more helpful than USCIS. Good luck
