    OK just called USCIS with great difficulty they escalated it to Supervisor , He took my details and informed and nothing is in system yet. Then i asked him about procedural changes , as per him everything "SHOULD" be on HOLD earlier. Hence he expressed concern that none MIGHT have returned . BUT he adviced me to call back during last week of July just to be safe on side so that we can make sure they are through atleast by deadline of Aug 17. For me what he told makes sense.

    I think next time any one of us talks to USCIS, we should ask this question as to "Whether they have generated any rejection notices for apps received on July 2 2007 and have they mailed them".....my attorney says so far they have not received any rejection notices for apps filed on July 2 2007.

    not even 2002, it's just 01Jan2002, means only 2001.

    EB2 person who applied for greencard in 2006 getting the GC wth the person who applied in EB2 - 2006.

    This gap between EB2 and EB3 is keep on increasing....

    EB2 move is in Months....EB3 move not even in Days...

    I'm not against EB2... but just comparing.:(

    Such is our seriousness, the thread barely started it was at the bottom of the list just awaiting its natural death. Whereas the most meningless threads are at the top of the list. If people can not EB3 backlog seriously then i am sure they don't deserve any GCs.

    Hello,
    I would like to clarify that this thread is not about discussing IV donations.
    Initially I proposed a special fund raising for Recapturing Visa Numbers to pay for the lobbying efforts and all expenses that would incurred by the IV team.

    For people who question why money is needed to do these activities, I recommend doing a google search to understand how bills get formulated and passed, on how lobbying works etc. Or they could open a special thread to discuss these things.

    Can you imagine how this organization could be run, how the IV team could meet with the lawmakers and USCIS authorities etc. Everybody have their family and work commitments/schedules. Sacrificing your personal time to do something that would benefit an entire community is an exemplary and commendable deed. It is always easy to ask questions or type in few comments from the comfort of one's home. Pursuing a common goal and acting upon it with dedication and sincerity is something else.

    Simply put, by making donations we are helping the IV team to achieve our goals in the arena of legal immigration reform. It may not be the most efficient organization in the world, but it has been effective and I have personally benefited by IV's effort since July 2007 and have made regular donations to the IV fund. Of course there would be people like Snathan who would want to kill ideas and proposals. These are to be simply ignored, as we already deal with lot of shit in our lives.

    Saralayar, to help generate statistics I have updated my profile with the important dates now. I will update them with more info later on. Thanks.

    This thread is to discuss efforts to achieve the goal of recapturing visa numbers for EB categories. Any new ideas, proposals, recommendations for the IV team are welcome. It also includes fund raising and ways to pay for this effort.
    The least we could do is to make donations to help achieve the goal.
    If you can contribute some ideas, some money etc, wonderful, great!. Otherwise please don't say anything negative that is of no use to anybody.

    I'm getting confused on the date part after reading various posts.

    Is it mandatory to wait for 180 days after I140 to port your PD from an old I140 to a new I140(with a different company) ?

    To change jobs and continue the same GC process I believe one has to complete at-least 1180 days in I485 stage. However in this stage the new job title and responsibilities should be same

    I guess Employer cannot revoke I-140 after 180 days - You may want to check with Immigration Specialist/lawyer

    My PD is March 2010 EB2 so i'm not even in this race yet but help me in understanding one thing.

    Was EB3 current in July 2007? If yes, I'm assuming atleast 95% EB3 folks have EAD and their spouse can work. The really big problem in post 2007 EB3.

    Since dates were current in July 2007, Eb2 and Eb3 can atleast enjoy EAD/spouse working benefits. Why do ppl complain when they have EAD etc whose PD is before 2007.

    Yes EB3 was in Jun 2003 in Jun 2007 bulliten and July 2007 all were Current. EB3 was in 2001 or so till May 2007 Bulliten. Most of them waited few years to file 485.

    We all know that people on H1 status pay federal,state and social security tax. So I checked IRS site and searched for H1B. They have couple of links that shows H1b should pay tax. My point is everyone knows IRS and they know how much they go after people who are not paying taxes. If we can point to IRS which itself states by way examples that H1B should pay tax then at least the fence sitters will not jump on their side. I doubt if hardcore NumberUSA supporter will believe this anyway but we need turn the fence sitters around which may be the majority.

    Here is the first one:


    I have an H-1B Visa and my husband has an F-1 Visa. We both lived in the United States all of last year and had income. What kind of form should we file? Do we file separate returns or a joint return?

    Assuming both of you had these visas for all of last year, you are a resident alien. Your husband is a nonresident alien if he has not been in the United States as a student for more than 5 years. You and your husband can file a joint tax return on Form 1040, 1040A, or 1040EZ if he makes the choice to be treated as a resident for the entire year. See Nonresident Spouse Treated as a Resident in chapter 1. If your husband does not make this choice, you must file a separate return on Form 1040 or Form 1040A.     I wrote to the IV team about 3 weeks ago and no response so far.

    I wonder who wants to take credit for the elimination of the labor substitution provision that has been (mis) used by the immigrant community as well as some employers. Labor substitution was one of the reasons for the back and forth of priority dates movement. Thankfully, effective July 2007, the labor substitution rule has been eliminated.

    The immigration system was more of screwed-up one till March 2005 (not that it is no more a screwed-up system now) when the PERM was introduced. With the introduction of PERM, the priority dates were common for EB labor certification nation-wide. Prior to March 2005, we had a screwed-up policy of state-wise labor-certification backlog where those who filed from states like Maine or Nebraska had an advantage of getting not only the approval of labor certification (form ETA 750-A/750-B or ETA 9089) faster but also having the Green Card in hand much sooner than those who filed from other states.

    Though the introduction of PERM, removal of labor-substitution, and the 180-day rule for name check have noteworthy and life-saving benefits for immigrants, there needs to be more transparency from DOS/USCIS on how the EB GCs are allotted or wasted unused.

    My $0.02:

    Add this option to the poll as well to get a realistic picture:

    I will not buy a house tomorrow (even if I was promised a GC this evening) because we are in a recession and/or the real estate market is spiralling downwards.The 1 MM people in the line for EB green card (quoted from singhsa3's 02:48 pm post #6 http://immigrationvoice.org/forum/showpost.php?p=227738&postcount=6) as you say are highly skilled. And even though they have the money are not financially stupid (at least a significant chunk) to buy a house just for the lure of a green card. This "smart" significant chunk will buy a house when among other reasons, they believe market conditions are right and are comfortable with their decision. A house might be your single-most biggest investment/asset/liability that you will ever have and even a "gold" card (forget green card) will not make anyone place such bets.

    We bought our house way back in 2002. We still don't have our green cards, but we bought it after evaluating the risks and rewards.

    Honestly, I think it is a waste of time to try to educate Americans what is what in immigration system. We need to push for our issues by proving why it is a good thing for the country, and not get caught up in this vs that. OK, so you convince the editor that the rally was not about H1Bs. All he will do is wack the sentence about the rally out of the article, because now it does not refer to the topic of the article, which is about H1 visas. Would that be an achievement? Hardly.

    I agree with you partially. It may not be achievement but at least readers will not be misinformed and become aware about our real agenda.

    Can you please monitor the threads more closely and remove anytning like this. If you are running out of resources, please add some more guys who can do this. There are many guys who always post constructive threads all the time. I may be one of them, if you look at all my previous posts. I can help in cleansing some bad threads here.     Sorry about the generalization. I was refering to Senthil1 kind of folks, not folks like you. Thanks for all the support. My friend got a green card as recently as a month back, he struggled for a long time before he got one, I asked him if he wants to come for the rally and he told me "MRRRRRRRR I GOT MY GREEN CARD, YOU ARE ASKING THE WRONG PERSON FOR THE RALLY" and the same person told me "SOMETHING MUST HAPPEN TO THESE ROTTEN CONSULTING COMPANIES, THEY ARE RUINING THE SYSTEM" he got his GC from a small consulting company and after getting his GC he says these companies must not exist - he wants to shut thee door behind him

    Those Asian Americans who are against new Asian immigrants, which include some of my relatives, sadly to tell you, are just helping White Americans in this fight. It is their wish and their passion. But if White Americans don't want it, they will have no chance of getting their voices heard. Not all White Americans are against immigration. But there is a big percentage of White Americans who are either fiercely against it or do not want it. I can hardly find any White American who says he or she wants more immigrants. And a small percentage of White Americans are fiercely against immigration. They would curse at anyone who they think is a new immigrant at any opportunity they have.

    I went back and reread the July 2001 Bulletin.
    How difficult would it be to lobby for extending the same logic for removing per country cap ? I am sure removing 7% cap would definitely help.

    Also since EB3 World has a cut off does it mean that no visas will be left from the world pool which can be recaptured ?

    The way I read it is ...People with PD's earlier than 2004-05 have been their long enough to understnd the pain and hence are active in all these forums , participate in such polls etc.

    Others are happy with their EAD's and know anyway it's going to be a while and are in hibernation ...cannot blame them ...this GC following can get stressfull ....ignorance is bliss....suddenly the laws might change or something like July 07 might happen again ....

    I think only those who got stuck in the Labor backlog (This could be huge #) and few other unlucky ones like me are the ones who are still waiting in India-EB3 Catergory pre 2004.


    I know a bunch of India-EB3 pre 2004 got approved in the gold rush of July 2007

    My guess is that except for the early years (2001, maybe 2002), EB-2 timelines will be almost identical to EB-3.

    Supporting reasons are -

    1. As things stand today, EB-2 differs from EB-3 only in the amount of wages required when filing the petition.

    2. EB-3 filers will naturally earn more money with experience and file fresh for EB-2 when they can.

    Other things such as qualifications and 5 years of experience are easily obtained and not relevant with such long timelines.

    In the new year, I have not seen any posts expalining how IV is "working" on resolving our issues. All that is posted now is requests for money. I know more money is needed and would be glad to contribute, if only the senior members show that some serious efforts are being made in the background. Yes IV did do very good work last year, but that is history now; but what work is going on now, nobody knows. Don't need details, but even broad details will help. Is something being done for appropriation bills, no one knows or tells.

    For example, after the elections no attempts virtually no attempts have been done to do webfax campaign tragetted towards pro-immigration inclined politicians. No lists have been made of such politicians. Just by waking up few days before the bills are discussed is not going to help.


    Once again, like many other posts that pop up at the rate of 1/day, very reasonable remarks. For a change they are civil. I have thought about all of them.

    The only difference is that I have some more time these days to think of the big picture. I concluded that the absence of these issues (and numerous others) is really not effecting any progress, and I can ignore these issues and contribute to progress.

    As a concrete example, I have thought of webfaxes/lobbying. Based on my analysis (which is completely independent of IV) of the current state of our bill, nothing significant is happening about it right now and it not posible to gauge the future. Thus, it is not an effective point for webfaxes/lobbying. With this conclusion, there is nothing to say.

    Everyone is entitled to his/her opinion as long as we move ahead.
