From the poll results for EB3 priority Dates, I think, I learned something. People waiting for Green Card Pre-PERM are way more than people Waiting POST-PERM. This is an approximate comparision(before Dec 2004 and after Dec 2004, though PERM started in Apr 2005.)
What I am trying to see is, Whether we can very little membership from people who started their GC process after Mar 2005. If that is the case, why those people are not joining IV? Believe it or not, They would also love to have their GC's right now. Something seems to be wrong. We should probably come up with some ways to target those people who are still waiting to file their I-485 or having their Labor Pending.
What do you all say?

.. there should definitely be some policy interpretation at the discretion of the USCIS
1) The law does not explicitly state that the visa number availability is a pre-requisite for filing the application
2) If you are interpreting it based on the words ....
"an immigrant visa is immediately available to him at the time his application is filed"
Then according to 245(a)(2)....
"the alien is eligible to receive an immigrant visa and is admissible to the United States for permanent residence, and "
....concurrent filing of I-140/I-485 should also be illegal because at the time of filing I-140 there is no determination of whether the alien is eligible to recieve the EB visa. If so how can USCIS allow filing of I-485 at that time.

In my Opinion all non-immigrant s require to get the comprehensive conclusion on the STRIVE Act first before going through.
STRIVE Act is to reform the deficiencies in current Immigration policies so that it streamlines the immigration process and makes easy for the immigrants to join their families and also make the kids of non-immigrants who were bought to this country of not their knowledge/ choice able to work �
If the immigration process is proper there is no requirement for the people to come here and work illegally. Under new work process this illegal immigration can be resolved is the Point brought through these STRIVE Act.
Some of IV members getting to these meetings and keep saying I am legal and not able to get visa because there is no visa numbers available. It directly implicates that if there are Visa numbers available we are not here to support this.
In reality that is true if you happen to see the people who already went through the process, they always say/wonder why they are making the process so simple. In some occasions when the Labor certification process is made premium processing the questions/comments raised by GC holders is, why they are making this process so simple/ OO they are giving the LC just like that etc. once the GC is in hand no one will talk about anything.
Off these so called 12 million Illegal people can make the country aware of these problems in one moment and they can make the country stand still by calling a day or more off the work. In other hand, we so called high skilled immigrants (prefer calling high labor) they never, able to make this aware off. Not able to call a single day off the work. Even if they do they will make sure that nothing feels the absence giving automate script etc. Under legal doing illegal work is this high labor. Take consensus and you will find at least higher percentage will say they are always work more than 40 hrs a week. Which does legally illegal work? In other hand illegal but doing legal work in this country is the illegal immigrants they work for by hour and if they work an hour extra they collect for that also.
We always want the process from higher level, want to meet Law makers and want them to reform and understand the issue. But always forget the basic the Law makers are made by people. Did we had a chance to make the people understand this? Higher percentage of companies in this country employ immigrants and leaving the few exceptional company at most 10% of the work force in average is immigrants. So did we any time educated the reset of 90% our co-workers? We never do go and ask them they will start ask you what is work visa?
So we never try to make the people around us aware of the issue but we want founds to meet lawmakers, and make them understand. So instead how much you are donating, how many people around you making aware of the issue is better. Did you manage to educate 90% of your company aware of this issue is very important.
If you want really a change, start wearing protest black badge till the law is reformed and start educate the people around to aware of the issue. Possible meet your company top level people and make them aware of. Among these there will be lot of people kids, nieces, nephews, brothers, sisters, spouses, friends of law makers who can chat with them without appointment. Of these there are many hidden people who can pull the strings in so many unknown ways. At that point you are not half million your strength is multiplied people are aware of this.
Of the all my request is please do not behave that Visa numbers are not available so I am here. Do not put the behavior before Gate Pass something and after the Pass what is this type.

Your statement about 27% limit holding does not make sense ! As per the visa bulletin if numbers are not filled up in a particular category they will go to unsubscribed countries. Here is the excerpt from the April Visa bulletin:

Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual �per-country� limit. Interesting that I did fingerprinting only in 2007 Nov/Dec after applying for I485 during the July 2007 fiasco. I have not received any fingerprinting notice since then. Guess I made an impression with my fingers. :)

When you get 485 approval you will not need EAD or AP :D
It's OK to file for EAD and AP yourself, I did it 4 times but you need I-485 receipt notice and I-140 receipt and then approval notice to do that. So if you are wiling to wait till your lawyer get notices (it could be months for those who are filing in July) and your employer and lawyer will provide you a copy of all notices - it's fine to file yourself.

Anyway we should close this issue.. I do find tawlibann's posts decent and non-offensive.. Only thing is we need to practice some respect to the communitity when chosing a handle... Its just not this.. there could be potentially other offensive handles.. So I'd say there should be a step/check in registration process to monitor/regulate handles... You won't like any handle offending your religious beliefs, dis-respecting your nation or humanity itself...
Just my 2 cents... We should stop this discussion and focus on immigration issues...

And color photos of expiring EAD when renewing that too

Immigration Voice is starting a feature for recurring contributions per month. You can sign up for $20 or $50 or $100 contributions per month and a secure paypal transaction will deduct this amount each month and contribute to Immigration Voice.
The question is, why should you contribute and what are the stakes? We have seen no reform from congress the entire year of 2006, so what is the point now? These are the questions, right? Is it even legal? What is the oversight of funds?

The goal is to have a total of 2000 contributors for recurring contributions in the next 1 month. Trust me, this is not difficult given the numbers we have even today. 8400 members, $ 200,000 raised so far. We can do much much much better than that.
However, do the math. Some people have contributed more than 500. That
means that with 200,000 coming from 1800 members, some have contributed
nothing. Well, I understand the fears and apprehensions people have with new
organizations asking for money and I am going to address all those
questions and answer them one by one. So that the only reasons left after
that for not contributing would be excuses. (unless you have another question...in which case, call us at our number 850-391-4966)

I actually don't think this is the main concern of many people who have not contributed. I have talked with many friends who got stuck with their GC applications regarding IV and urged them to contribute. However, not many of them were very passionate about this. They just simply believed that they could not achieve their GCs faster with IV's effort than without. $20 per month is not a big deal for them. But without any confidence and hope, they did not even want to bother to register and contribute. Most of my friends are EB2 with PD 2004 or later. Some who have filed 485s see no sign for SKIL being passed and are fine with their APs and EADs. Those who have not filed their 485 truly believe that they could file their 485s in about 2 years and got used to this waiting.
So I think maybe we can let people know what IV has achieved in the past one year(not just how many members or how much money IV has achieved..., but things really matter to people) and inspire them.
waitingGC, Well said. Your assessment about this group of people may be correct. These are mostly apathy-stricken people with indifferent attitudes towards the events and surroundings around them. No change can be made with such an attitude. If it were for such lazy people, no revolution/change could have been organized and this world would still be be under imperialistic forces. Sloth is the biggest sin and an example to sloth is well demonstrated by the behavior of these people who refuse to participate.
What Results?
I joined IV recently and I visit IV website several times a day. Few days back I had the patience to search and read earlier forum discussions on IV and immigrationportal. I read the forum threads in which it was discussed how IV delivered all the amendments in the last year Senate bill. What more results do these people want? I admit that I don't understand all the amendments and all the provisions that IV got for us in the Senate bill. But isn't it a big deal to simply organize in the matter of few months and then get our provisions passed in the Senate. What more results should we expect to judge IV? The only other result is when IV will get all our amendments in the next immigration bill that will be passed by the congress. By then, it would be too late for these people, who refuse to participate at this time. And I don’t plan to wait for them. So I just signed up for $50/month monthly subscription. More importantly, my wife and I will request all our friends to sign-up for monthly subscription.

Making dates current for everybody will benefit new members (those could not file in July/Aug 07). For you with Nov 04 PD in EB2, and others waiting with I-485 filed, it will create a chaos. USCIS folks will get green to pick any file at random and issue GC's, then we all be unhappy.
They should move cutoff dates in an orderly manner without retrogressing them in the future. Retrogression pains more than no or little cutoff date movement.
