    I find it hard to digest why would they mind if some one has been to India recently?

    Does this argument apply just for the indians or does it apply to individual of any nationality?

    THey have eradicated malaria from north america whereas we still have it in India. They dont want us immigarants or wanna be immigrants to spread diseases!!

    I tend to think a point system is better than what we have now. One thing though is that the points should be allocated "properly". For example, more points should be given to people with higher education, who earned a US degree, who have worked in the US for more years, who have paid more taxes, etc.

    Someone mentioned a good point is about the visa number limits. If the per country limits are not eliminated, the points system won't solve the problem. Of course, they should also give more points to people who have passed Labor and I140 and allow them to adjust status right away. Otherwise, we will further get stuck in all the backlogs. Poor us. :(

    I think if all the above issues are solved/cleared, probably a point system is good for us (i.e., EB based immigrants who are now stuck due to backlogs and retrogression). :p

    Its very interesting to read about people�s different perspective about same thing we are all after.. lets ask ourselves.. honestly why we do want GC and I am sure we all would have multiple reasons for this in our subconscious but would not like to bring it to forefront because it would only undermine our own ability to fight it or make life more stressful.. but end of the day we all want this card.. for me I want it mainly for security and peace of mind�lets look at the different situations.. these might be extreme but we all might have thought about these situations atleast at some point in the recent past� .. and especially the people in the seventh year

    1. You are in your seventh year� and you loose you job�.what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave�forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist �

    2. You have home which you bought with so much pride�what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave�and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..

    3. You have child whom you love and have plans for them.. love the school.. are an active member in the PTA � all of sudden what you do.. pull them out of school, move them from the only culture and the country they have known the only President they know is Bush and the only national anthem they have learnt is "The Star-Spangled Banner"�to another place where they don�t even understand the language forget the culture, national anthem etc..

    4. Think about your spouse.. they have adopted themselves to this lifestyle.. probably felt lonely when you moved here 7 years but now like it.. its time for them to move back�why because your don�t have a GC

    5. Forget the Golf and Tennis you enjoy so much here �it was all a very good dream..

    1. You are educated.. have a masters, have a professional degree.. but have been in the same position and department because of your long wait for GC, what happens� the fresh college graduate or the dumb blond who joined two years back and whom you taught how to log into the network is now your peer and you are still on the same desk doing the same job getting the 2% raise and working even more hard..so that you can keep you job..with a new dumb boss.. who thinks you are so dumb that you have been in the same job for so long time..
    2. All your batchmates are doing great..some of them are now sweating to be VP�s having risen by changing jobs �. You are still years away from that situation.. what do you do.. stop attending alumni meets and envy the mails in your yahoo groups from people..
    3. Seven years in US.. you have made your professional contacts.. and have a social network.. in which you invested your time and effort.. loose your job in the seventh year.. and all these contacts are nothing but an occasional international long distance call in future..

    Last but not the least� flight back home to your country is not going to be as smooth as the flight to US was seven years back.. back home look for a job..learn the whole new professional culture �and then set up a new home,,new school for kids�.why because we could not get a GC.. which was not in our control.. and because some stupid insane guy sitting in cave 10K miles away decided to terrorize the people in America in 2001.. and make life difficult for all the people..including people in H1...

    We might all go back to our home country one day.. but the ride back home would be much more pleasant and happier of a choice we made and not because we did not get a GC�

    First and foremost, if you lose a job, it doesn't matter what your immigration status, life is going to become difficult for you and your dependents.

    I lost my job in the 7th year of H1 but since I had well researched and planned for that scenerio before entering into the 7th year, I am still here in a new job with an anticipated 3 year extension from 2007-2010.

    If a lobor from your previous job has been pending for more than 365 days, you are able to port the benefit of the 7+ year extensions to the new job. This will let you survive the 7th year job loss.

    Likewise there is a "best possible" solution to all the hardships that you have listed above and that "best possible" solution will vary from person to person and hardship to hardship.

    Life takes planning, no matter what your immigration status.

    My friend who is an EB GC holder just sold his house and took a $40000 loss. Bad planning on his part. Purchased the house at the wrong time and sold it at the wrong time too.

    Since he sold his house, he is forced to move and so his kids schooling is distrubed too.

    Its been 3 months he has moved to his apartment and his other half doesn't like the apartment lifestyle after having lived in a house for a year.

    Did his GC help in all this???

    Compare that to me, I am not a GC holder.

    I am sitting on $240,000 equity in my house for which I have no plans to sell.

    I too was forced to move due to a recent 7th year H1 job loss, and miss my boating trips to the lake near my old house. My new job is a 100 miles away from my house so I decided to do weekend commutes to the old house, and still manage to hit the lake every weekend.

    My better half also didn't want to move in an apartment due to my new job. Good enough, we leveraged the equity in our 1st house & higher income from the new job to buy a 2nd house near the new job site.

    Did my not having the GC hurt???

    GC or H1 didn't matter, good planning is what has helped me, and bad planning is what doomed my friend...

    I think it is individual decision to go back to home country or not. But taking a global look - We Indian make more money here. Average salary of Indian is $65,000+. We can save more. We get more comfortable life style. Only problem is GC, H1-B.

    I hope you will not be surprised that many of us have gone back and started our own company and are successful.

    If you marry a girl after geting greencard you have to wait 5 years to bring her to US. So better yet, marry after you get citizenship :D which might be when you are ready to collect your social security

    I just did No. 2!!! Yes, sold my home off recently and now living in apt. I am single and no family so I am more flexible when it comes to leaving the US. Also, because I have been in my field of work for 10 years and feeling a little bored with it and wanna go back to uni to try another field, but don't want to do it in the US in case I lose my job and then have expensive bills to pay.
    With that GC, at least I can feel more secure, will have the ability to find a local employer while going to college, etc.

    Please ...let us agree on this ...will get an EAD even if i-140 is pending while 485 is filed correct??

    This is not a democracy or an American Idol show where it matters what most people think!

    There is a law that clearly states it - you can file and are eligible to interim AOS benefits such as AP & EAD even when the I-140 is pending. I have colleagues (who applied 140 & 485 concurrently) get their EADs and APs long before they got AOS approva.

    It's a different thing, not not to be confused with, that most people choose to continue with their H1 and not use EAD or AP because of the uncertainty until the 140 and 485 is approved.

    We applied for my wife EAD/AP on June 7, 2010 (E-file)
    Her EAD was approved in few weeks back but there is nothing on her AP.

    Her LUD change was on 6/11/2010 when they issued the receipt.
    We called USCIS and initiated SR. Still no change in LUD.

    Infopass is not a great option for us (3 hour drive one way). Any help is appriciated.
    (We used to have POJ trick for calling NSC IO directly,
    Does it still work?
    If yes, what are the steps?)

    If point sysem is introduced the big losers are immigration lawyers as they cannot make money in multiple stages. So no wonder if they oppose. Of course there is some limitations but its sucess depends on rules and regulations. Also there is going to be a Cap and there is going to be a provision to prevent displacement of US workers as the worldwide demand is always here. But main advantage is it will bring down the work load of various agencies like DOL and INS also employers.

    It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?

    The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.

    Sure, your point is very much valid. What I understand from the Freakenomics experiment and EB3I behavior with respect to IV is that only a few folks have the perseverance to go all the way from D to B.

    Take 100 folks with C grade and give them the $50 offer for B. May be 80% will reach that goal. (I do not recall the actual results of the experiment).

    Take 100 folks with D grade and give them the $50 offer for B. Ideally we should see 80% of folks improving their grade to a C (one level up). But in real life only may be half as much (40%) will actually improve their grades to a C.

    Interesting experiment, and I can see that is how human beings respond sometimes.

    However we are guaranteed something in return when we TRY to do what we believe in, regardless of the odds as we see them: the satisfaction of DOING something about it, and a real shot at getting what we want.

    Easy to try it. Pick anything, literally anything about your life you want to change (from changing your job to losing weight to calling up your parents more frequently).

    Then WITHOUT THE FEAR OF FAILURE, do something about it. It will either work out, which will be terrific. Or it won't... maybe you don't success at that job interview after all, or you still put on weight. Even then, the satisfaction that comes from having TRIED is yours to keep! (Personally, I have found this to be more motivating for trying those things again, as opposed to the hopelessness that results from not trying and then seeing things not improve.) And of course, since failure is only one of two possibilities that there can be, you do succeed 50% of the times that you try honestly!

    In case of IV's efforts including the upcoming Advocacy Day, that is exactly how I feel.

    They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

    o.k...I hope you are correct. but how do you explain this ..my friend with a PD in 2004 EB3 had submitted incomplete medicals for his wife as they were expecting a addition in the family ..they submitted during the fiasco with RD in july / aug 2007 ..however no RFE's so far ?? (TSC shows processing dates in end aug 2007 ..which could mean that they are processing sept cases )

    Same with one of my friend - his PD is EB3 2005 India - he never received his FP as yet and is just planning to wait it out. Gets his EAd and Ap renewed regularly.

    Thats an ROP plan... yes, that you can get it for $100/month.

    I am questioning your statement of "getting 1 million insurance for $100/month till the last breath"
