Listen dude, these companies doesn�t have financials like Microsoft so no point talking microsoft. I have a friend who runs a very small consulting company. Another friend of mine wanted an H1 for his younger brother He made 100 promises to this guy , like please bring him here he�ll work for you for atleast 1 year blah blah. I requested this friend of mine and he sponsored my other friend�s brother�s H1B.. Now this guy sponsored his H1B spend $3000 on fees etc. $1000 for air ticket etc. This brother guy came in and disappeared in 2 months for more money. He was on project!! he jumped in the middle for more money. Now you tell me what should these people do. It�s all same people just in different roles. So I would say there is a stiff competition between consultant and these companies about who screw who.

The 1 year of BCom was not required to enroll in the Diploma. However since my field of expertise is Management we were able to combine the 1st year of BCom with my 3 years of Diploma of XYZ Management. My Labor Cert also states that academic studies equivalent to a US Bachelors.
It is important that everyone understand that each case is different. In this case was the 1 year of the BCom required for admission into the diploma program? Otherwise in my opinion (and anything can happen with any one adjudicator at USCIS) it souns like you are combining, which is allowed for EB3 when so stated on the Labor Cert.

Trust me. You would see an approval this month. Most of the people who got an LUD on their approved I-140 on 07/13/2008 are seeing their GC approved. Only uncertain people are those who hasn't seen any such light.

He is ***ing desi employer and is counting on me as if he has to take some personal revenge..please kindly suggest all available options..?
Can i file my taxes thru HR block on basis of his paystubs(and checks) and bank statements?
I came here in 2000 through a desi consultant. After landing, he made me a sign a contract that i won't leave him within 1 year or else i need to bear fines ( he didn't tell this while giving offer letter in India ). Then later he kicked me out after 1 year ( because of bad time there weren't much projects ).

What does such a response mean?
To me, it is evident that IF the action is clearly defined AND some one has a clear mandate, then people will come together to participate and contribute.
I am tired of hearing how the loopholes in the immigration system are taken advantage of. If we focus on increasing the cap for Indian EB category [across the board] and recapturing the lost visa numbers, then the remaining problems will take care of themselves. For this, we need to lobby until we get a reform legislation to pass.
And for people that are furious that a very small percentage of folks are taking advantage of the system, i urge them to look at the majority of the people that are leading a honest life and take solace. You are not alone in this journey. And don't let lack of GC put a damper on whatever you wish to do. Get creative and make use of the same legal system to achieve what you want. You are in the same framework as those folks that are taking advantage of the system are. Work the system in the right way.
I have neither met a honest person that has ultimately lost nor a dishonest person that has ultimately won. Please have some self-confidence and self-respect and keep fighting for what we truly believe in. When you hit a low point share your experiences with others here - in a productive manner.

Not sure if this is a good idea, 1. Either to put a English note on How chinese is affected because of EB Visa Retrogression ? and pass the website and email id to join ?
Or get a person to translate it into Chinese and put it up in Ranch 99 - Milpitas, berkley, Fremont, Sanjose ? Ranch 99 is a popular place among chinese network to buy vegetables and well networked among chinese !
I am assuming there must be similar network of Chinese Shops in other cities !. I am going to ask students from china to post it in their internal mail aliases for wide coverage !
Some thoughts on this ? ALSO _ Indians perhaps can talk to Silicon india, then other Bay Area local newspapers to publish it ? - Put it up in Komala Vilas, Udupi, etc ?

If USCIS says, there is no problem to continue with our employment as long as we have applied for EAD renewal, there wouldn't be all this emotions. Every one would have normal BP. They must just come out and say that I would be ok to continue working.
It is so inhuman to treat us like this. They say "The day EAD expires, you must quit working until you receive the new EAD card".
Most of our jobs are replaceable in today's world. There is no shortage of "skilled workers". So, I for sure cannot take a long leave and wait for EAD to come by and re-join....because my job would be gone by then to some other "skilled" person. And its not easy to get another one quickly and without moving to a different place.

It says some applications will still be delayed . I assume of one is stuck with namecheck where FBI is waiting for response from native country, he will be waiting for eternity. Nowhere it says applications will be approved while the namecheck is pending.

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.

You are thinking only about the small percentage of "lost Indians" (including me) who are in this mess - if you really think about your motherland (and mine), help guys like NRN get a good infrastructure in place. No. I am not anti-immigrant. I am anti-illegal immigrant. I know the AZ law very well coz I read it not like many who seem to listen to talk radio. Good opinions can be formed only with good knowledge and we don't need evryone to have an opinion. Most should only subscribe to an opinion otherwise there will only be infighting and no progress.
