My Job duties on labor says
"Design, develop and test software using Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP"
The title in labor is "Software Engineer"
Now the new job offer has title as "Lead Developer"
and duties are
"The lead developer will be responsible for leading a team to creating components within Java, utilizing standard Integrated Development Environments (IDEs), writing unit test cases and supporting the Testing and Quality Assurance phases of the software development lifecycle."
Can somebody comment on this in context of same / similar job?

Bujjigadu123, do not forget to graciously ask him,
1) What is this appointment for visit about?
2) What is he going to do with the information that he is collect from you? Specifically when he collects personal and sensitive information.
3) You should ask if its possible to meet at workplace or somewhere else other than home.
I would not be comfortable meeting unknown people specifically at home with a single phone call, its not safe too.

My wife went to India last month on AP via Frankfurt without any visa. She faced no problems while going and coming back.
While coming back, at the Indian airports, they do check for the visa/ap/gc before they let you aboard.
I guess the confusion part is that the consulate's version of the visa requirements do not match the visa requirements enforced at the airports.

I would like to know How to file a complaint about labor fraud? I just found out that my employer didn't file 485 for me and instead he used the labor for someone else. Is there anyway I can file a complaint? I have no other option except to wait until the dates are current again. I paid all the expenses for labor, 140 and 485.
I don't think I can truly understand how frustrated and angry you must be and I really hope there is a legal avenue by which you could atleast get some kind of monetary reward. I hope you could take this employer through the DOL fraud dept and cause him to really pay for this.
One of the side benefits of the end of labor substitutions is that unscrupulous employers like your desi employer will not be able to sell a labor to the highest bidder or give it away to a new hire as a 'sign on' bonus. Either the original candidate gets it or goes to waste. Though it seems a little tough, it more than makes up by preventing such stories as yours in the future. Good luck

My advice is to take a new job, leave the current employer on good terms and forget about AC21.
One more question, If we opt for AC21, can the previous employer revoke I140 (After 180 days) ? will that impact I485 ?

dint had much time to go thro' your responses. but if senior ppl are targetting this fellow( mercies) for this thread, then i beg to differ. because as a member of IV, i have been answering "hadron" posts too at immigration portal.
I think all Mercies is trying to do is help IV out, by preparing answers of such questions which stupid ppl ask, so they can be put to a stop right away. Probably he's drawing your attention to some q's that all of you have answers for, just guide mercies to that post,
but i think all of your remarks have been directed towards merices only as if he's started it all.
i guess we outta stop ppl who are trying to defame this collective effort by giving them one-point answers.

Q. Why is this policy being implemented?
A. This policy change is in response to a 2005 DHS Inspector General recommendation that USCIS align its background check screening policies with those of U.S. Immigration and Customs Enforcement.
Q. Is this policy consistent with the national security priorities of USCIS and the Department of Homeland Security?
A. Yes. No application for lawful permanent residence will be approved until a definitive FBI fingerprint check and Interagency Border Inspection Services (IBIS) check are completed and resolved favorably. In addition, in the unlikely event that DHS receives actionable information after the application is approved, it will initiate removal proceedings. Lastly, in general these individuals have been in the United States for some time and have previously been subjected to DHS background checks.
Q. What applications are affected by this policy change?
A. Applications included in this policy are:
• I-485, Application to Register Permanent Residence or Adjust Status;
• I-601, Application for Waiver of Ground of Inadmissibility;
• I-687, Application for Status as a Temporary Resident Under Section 245A of the Immigration and Nationality Act; and
• I-698, Application to Adjust Status from Temporary to Permanent Resident (Under Section 245A of Public Law 99-603).
Q. How many applications for lawful permanent residence are affected by this policy change?
A. USCIS is currently aware of approximately 47,000 applications for permanent residence (I-485) cases that are otherwise approvable but for the fact that an FBI name check is pending. started to wonder if there was more between Kumar and his roommate than
met the eye.
Reading his mom's thoughts, Kumar volunteered, "I know what you must be
thinking, but I assure you, Sunita and I are just roommates." About a
week later, Sunita came to Kumar saying, "Ever since your mother came to
dinner, I've been unable to find the silver plate. You don't suppose
she took it, do you?" Kumar said,"Well, I doubt it, but I'll email her, just to be sure."
So he sat down and wrote :
Dear Mother:
I'm not saying that you 'did' take the silver plate from my house, I'm
not saying that you 'did not' take the silver plate.. But the fact remains
that it has been missing ever since you were here for dinner.

It will in effect nullify all your efforts. It has happened in the past and it's sure to happen in the future.
So, please excercise due caution. Do not share information with the folks you don't know very well. These kind of actions are best suited to be carried out in your state chapter mailing-lists, where members are screened before joining. IV forums being public anyone can create a fake id in half an hour or one hour. It's not secure to carry these types of actions.

Sanbaj, Is there any update regarding your case ?
None so far. No updates from the Lawyer or any LUD change. My I485 RD is 08/16/07, and NSC has not reached that date as yet. My lawyer's office called and the response was "The request is attached to the file (485)". I called NSC and the IO there DO NOT know the meaning of Interfiling and the IO I got was very rude and in a hurry to finish the call. She said that these officers should not give us (AOS Adjustees) any info, please inform me if any USCIS officer has broken that rulw. I said no one has and finished the call. Now, I am waiting, as have been for last six years for various things on the GC journey, for NSC I485 Processing status to go beyond Aur/16/2007. Once it does, I will call them again.

I called NSC and the IO there DO NOT know the meaning of Interfiling and the IO I got was very rude and in a hurry to finish the call. She said that these officers should not give us (AOS Adjustees) any info, please inform me if any USCIS officer has broken that rulw. I said no one has and finished the call. Now, I am waiting, as have been for last six years for various things on the GC journey, for NSC I485 Processing status to go beyond Aur/16/2007. Once it does, I will call them again.

getting a seperate quota for Masters from US has some teeth. The Congress passed a legislation for additional 20K visas for people with US masters. To match things up with the EB visas, there is need for additional numbers. We can thus argue for an there needs to be additional numbers for EB masters quota.
I think this might resonate with the congress. Unless everyone is just waiting for something big.

I think EADs are sent to the applicant and AP to the attorney...had the same in my case...plus seen lots of folks here say the same thing...
According to the lady officer all AP approvals were mailed to my home address and she verified my home address as well to make sure whether USCIS has sent them to appropriate address or not.
