AC 21 is complicated, the whole GC process is complicated. Lot of us are thinking 180 days ahead for changing employers.. please think about September 18th. We need to make a difference. Please attend the rally, please contribute, every effort taken by each of you makes a difference. Even if you don't believe you cannot make a change, WE DO! Wake up and lets all go to D.C!

Sen. Charles Schumer (D-N.Y.) maintained Wednesday that Congress will tackle comprehensive immigration reform this Congress, and perhaps even this year.
�All of the fundamental building blocks are in place to pass comprehensive immigration reform this session and, even possibly, later this year,� Schumer, the No. 3 Democratic leader, said during a speech before the Migration Policy Institute.

On your previous post you mention about salary hike and %ges...can you please clarify if a person continues to work for same employer (who filed PERM and 140) and salary hike is (base salary or bonus) 10% or more per year and AOS application process takes 2-3 years (so, total 30% difference in 3 years)...is that a negative on your application? or can it be a reason for denial?

So I am not sure if salary hike at the same employer would hurt AOS application in anyway. On the face of it, it should be a no brainier and we would like to hear that. Most of the times, we all want to hear our lawyer give us a specific reply, so even if they lawyer is telling us something which doesn't directly imply what we want to hear, we still think that that the lawyer is telling us what we wanted to hear - "selective hearing".
But some lawyers have told me that substantial salary increase (30% in 3 years can be seen as substantial) could be a problem at USCIS. They could argue that the job/job requirement/job responsibilities have changed substantially as there is a substantial change in the wage rate offered. So it’s a grey area. In effect, system is designed to keep us where we are till the time the green card petition is approved. I realize that this doesn't provide a definitive answer to your question and sorry about that, but this is as much as I could find out about the specific question.

What is EVL, is it experience letter.
No It's Employment Verification Letter which is supposed to be issued by your current employer stating that you are still their employee, earning this much at this title bla bla. Experience letter is something which shows your experience, the number of year worked in the company. Moreover, experience letter (EXPL) is needed for the old companies.
As far as I know, in I-485 you need just EVL and not EXPL.

If it is of any consolation, though not required, I did submit employment letter along with her I485 from my wife's company which states her current salary and that employer is willing to provide employment till her H1B approval expires.
It means, if at all they have any doubts, they may issue RFE, but if you have a good relationship in responding to those RFEs using company letters etc, there is no problem. Good relation means, employer has to suppprt you always in case of any RFE, thats it. He needs stand on your side. Then there is no problem. But if he won't stand on your side, then it is a problem. So, thats why relation with employer is very important when on H1 or EB.

Meeting with Congresswoman Zoe Lofgren�s staff, San Jose

A group of us met with the with Chief of Staff and Congressional Aide at Zoe Lofgren�s office in San Jose, yesterday. The meeting went very well and lasted an hour. The Chief of Staff was very knowledgeable about the issues. She ofcourse knew that the IV team had already met with the Congresswoman and the staff at her DC office. One of her first comments was about that meeting and she remarked that it was very good to have � an organized group� like IV. She was very appreciative of what IV was doing as an �organized group� � doing their homework and research and putting out presentations and materials that brought out the core issues very clearly and hiring a very competent lobbying firm to help execute our agenda. She wanted to know who made those presentations (thanks to Berkeley Bee!!!!!) J.. In fact, she repeated her appreciation quite a few times about IV. She also mentioned that she had read about IV in the Roll Call and was looking forward to meet the group.
We went through the presentation, explaining the issues � most of which the Chief of Staff was already were aware of. The Congressional Aide was not aware of a few and we used the opportunity to explain the issues. Needless to say, personal examples helped to get the point across very well. While we went through the issues at the BECs and the USCIS, we quoted quite liberally from the Ombudsman report and the Presidents Economic report and from logiclife�s post on the backlog centers. At one point we were asked/ told that since these were infrastructure problems that are very deep, it is probably going to take time to completely address the fixes in the system. We again took that opportunity and told them about IV goals such as the 3yr H1B extensions instead of 1yr and the recapture of the visas lost between 2001 and 2004 - which would provide interim relief to the people affected by the backlog. We explained how the 3yr extensions instead of 1yr would relieve the USCIS of additional work and allow them to focus their efforts on actual processing / clearing of backlog. When they commented that the Dept of Homeland Security may want this to be a 1yr process, we pointed out that currently 3yr extensions are being offered to people who have filed for I485, so we are merely asking that the same be extended to people with their Labour and I-140 pending.
They offered us a couple of suggestions:
1. To talk to the Congress people �on the other side� especially in the Judiciary committee. They wanted us to consult with our lobbying firm first. They strongly felt that we should be talking to lawmakers who are not pro-immigration. They said that we may need to study their district and the industries there and try to point out how those industries are benefited by immigrants directly or indirectly.
2. To collaborate with the giants in the Private sector who employ highly skilled legal immigrants because some of them have very loud voices on the hill.
We do have an action to get back to them with a list of states that we know that don�t issue drivers license renewals for 1yr. Can someone please provide us with this information so that we can relay it back to them?
They also wanted a softcopy of our presentation and the supporting materials. We are working on that.
Overall, they had a very good opinion about ImmigrationVoice. To quote them again,
�Very Organized Group� � and they felt that organized groups make a great difference,
�Done their homework very well in terms of research, pinpointing the exact issues, presenting and communicating them in a way lawmakers / people understand�, �Have a very good lobbying firm�. They wanted IV to continue what we are doing and meet with lawmakers on either side (pro and anti immigration), so that when a �window of opportunity� presents itself, we can use it to our advantage. The Chief of Staff reiterated this point and mentioned how important it was to be prepared for this �window of opportunity�.

We have been calling and talking to ppl all over new england area.
But we have hardly been able to get a convincing number of ppl to attend the rally.
Have you watched the bus thread for New England Area. 26 votes, can you believe that.
We definitely need to get more innovative. I dont know what ppl want, so they can be motivated.
Sometimes i think being educated is a curse, as ppl become more scared and are fine adapting to the system.
Look at the ILLEGALS at least they came out openly. They dared to come forward and i am sure they will be rewarded sooner.
LEGAL ppl who have nothing to fear are then also they are more scared to do anything. So this is the right time for me to express my opinion LEGALS ARE FOOLS.
Please dont be mad at me, i am just frustuated with ppl responses, but one thing for sure, i will keep on motivating ppl in whichever way i can do.

Though I live in a relatively rural area and initially felt I couldn't go due to bad flight connections etc. I decided to just go online and look for a flight and see how it goes. I found a good deal and booked it just now. Though it is just for one day go 17th and return 18th evening, I felt it is our final shot to be heard until 2009.
It is a flight to Baltimore airport which I understand in 30 miles away.
Now my question is, Is there anyone who is willing to host me and/or drive me to the rally?
FYI those of you in Michigan, you can get really good deals on northwest to baltimore.

I understand your mental condition because my Labor was also traded in market during 2004... Dont take any impulsive step by reading forums ! Make sure you 've correct docs and stuffs before letting employer know that you sued them. Remember they can revoke H1B anytime showing completely different reasons.
Also remember you have to pay for your lawyer - this is not going to be a 'class action' or any 'criminal trial' that you be will assisted with lawyer.
I'm not discouragaing you to complain against wrong-doers but be ready before cracking down on them.

OK, they'll raise the fees (I can live with that). But how do we improve the chances of better services?
USCIS is asking for comments....If IV would be so kind as to submit comments for the raising of the fees. I humbly throw these out for discussion:
Accept the fee increases providing:
1) That USCIS propose public standards of reducing processing times to 30 days+10 day security check.. Automatically produce an EAD if it takes longer. Hey. We're all still in the country whether the process succeeds or not right? We would just appeal, submit more info or beat it until it's done. Who's any safer?
2) That RFEs not be used to manage work levels. Plus they ought not to reset the 90 day clock to zero if they issue one. That is ridiculous and unheard of.
3) That they simplifiy applications (a la Canada) so that "lay persons" can (carefully) fill in the forms. Lawyers not required.
4) That the USCIS abide by the laws. Especially regarding FBI name checking. We have a duty to follow the law. I'm careful to do so. The government should be careful to do so as well.. Call me a radical.
5) That they publish proposals to stream line the process with modern business methods and concrete goals. The increases should be tied to fulfilling stated goals of improvements of service. Otherwise they roll back. Have a 3rd (independent) party decide if the goals have been met in three years.
If we tax payers are giving them extraordinary increases in fees, we should at least expect some meaningful process improvements. Simply claiming that they need-the-cash-for-process-improvements is not sufficient. What is to prevent them from using the money to give everyone big raises and bonuses and a nice fancy new office, and big fancy new computers if they're going to continue to use paper and use the computers to access rickety old systems with terminal emulators? I'd love to deal with happy USCIS employees, but I'd love it even more if I had to deal efficient USCIS employees. (Give them the tools and they'll be happier!)

It is good to get reliable first hand information from travelers instead of relying upon reports from consulates, airline websites etc which all contradict one another. Just out of curiosity, did anybody in India or Frankfurt ask to see the Advance Parole papers before allowing you to board the flight?

In the letter from the new employer include the following (start date, title, job description, salary and position type):
This letter is to verify that Mr. Cool Dude (SSN: ) has been employed by our company as a full-time employee. He has been working with us since Oct 32, 1666 as a Full Time Gamer.
Mr. Dude's primary job duties include:
