Hi,
I feel that per country quota for EB green cards is ridiculous. A skilled worker from India and China has to wait for GC 10 years, whereas a person from ROW gets it in few years/months. I wish I had known all the delays/pains in GC processing before I started my career here. We should start an online petetion/a law suit to end this disciminatory quota and address it to President/all the congressman/all the media.
Simple questions in the online petition/law suit:
1) Do you think it is fair for a person from India/China to wait for 10 years whereas a person from other country gets it in few years?
2) When there is no per country quota in H1B visas, do you think it is fair to have it in EB visas?
3) Do you think it is fair to have the same quota for India/China compared to a small country?
4) Everyone is aware of the legal immigration problems here, atlease try to make it same for everyone.
Most of us are Ivy League or good college graduates and work in good companies. We can mention our names, school and company information in the petition. All those who don't agree with me, please dont respond.

In order to understand how a civil lawsuit works one needs to understand that in a complaint, one makes no legal arguments, does not cite case or precedent law but only cites the simple facts. The other side can respond to the complaint and deny or accept the allegations in part or in whole. Many cases do not go to trial, they end up in settlements or are decided through summary judgement (http://en.wikipedia.org/wiki/Summary_judgment) (for the plaintiff or the defendants) if the case has undisputable matters of facts and one of the parties petitions for it. I will not buy a house tomorrow (even if I was promised a GC this evening) because we are in a recession and/or the real estate market is spiralling downwards.The 1 MM people in the line for EB green card (quoted from singhsa3's 02:48 pm post #6 http://immigrationvoice.org/forum/showpost.php?p=227738&postcount=6) as you say are highly skilled. And even though they have the money are not financially stupid (at least a significant chunk) to buy a house just for the lure of a green card. This "smart" significant chunk will buy a house when among other reasons, they believe market conditions are right and are comfortable with their decision. A house might be your single-most biggest investment/asset/liability that you will ever have and even a "gold" card (forget green card) will not make anyone place such bets.
We bought our house way back in 2002. We still don't have our green cards, but we bought it after evaluating the risks and rewards.

Porting cases needs more research and with USCIS performance, you can say that it may have little impact on 2004 cases. The substitution cases filed in July are of 2005 and after cases. 2003 and 2004 cases all substituted before and i believe that is what created this mess for you and me.

My colleague's friend's story.
Went to india for 3 weeks vacation..at POE, officer called his employer and asked "do you need him(a H1B) to work for this position? Cant you find any US Citizen?".
Apparently, the response from employer ( I think Desi consulting)is, "Yes..we dont need him..can find a USC"..
The poor guy is sent back.
Now, I asked my friend to inform his colleague to come forward and post his story at IV..but I doubt if he cares Rat's as** now that he is kicked out.
hmmm...I have a travel coming up in Nov/Dec...with all adventurous luck going on with me, I have other plans now :confused::confused:

Dear All,
I have applied for L1 B extension and the Status is Pending Petition Filing with my Company. My visa Expires by Dec 14th 2009 and i have to travel back to India by Dec 18th 2009 immediately due to personal emergency.
I dont have any acknowledgement till date for the extension as it is under process.
Following are my question
1) Will i have any issues when i return to india after 4 days of my visa expiration?Will it anyway affect my future visa petitions?
2) If the extension is filed, Is there any chances for the extension getting approved even if am not here unless there is no RFE.
Your answers would greatly help me. Thanks

I sent a letter earlier this year to one of my Senators here in CA regarding my 2001 LC and the result i got was that the senators secretary checked my case with USICS and sent a letter stating that my green card was approved 2003.
For somebody who is still waiting for LC recruitment instructions this was a total waste of time and money ( donated $5000. to Senator).
Next week my attorney and i and his other LC DBEC clients are going to try and make an appointment with DOL and see if they will comply.
Number 1 point we shall pursue is to make a $5000.00 premium processing for all DBEC pending LC and have guranteed adjudication in 120 days for all LC with current PD.
This way all clients with current PD will obvouisly pay $5000.00 and DBEC can use the extra funds for remaining cases.

Just because you have 1485 filed much before your PD and have the better half of the situation, does not allow you to be an advocator on behalf of IV.
The question was means for IV and PAPPU, and to galvanize this organization to do something big, than take things for granted.

You did not submit because it was ok for you. I know people who got RFE asking for employment proof.
It might be case that their case numbers were associated with firms who were sponsored initially by 'desi' consulting. Hence more rigorous checks for them. I didn't submit employment letter. I wasn't even ASKED for one. None of the questions in form asked for employer name. None of the mail-in items included employer letter either.
