    I think Wah Wah is confused by the differences between 'retrogression' and 'backlog'. Of course, you are right that the PDs are not likely to go much further back (I think USCIS took a conservative approach after July - note they are still issuing visas to those with non-current PDs but are using the bulletin to limit incoming new filings). However, if 20 million applied in July the coming backlogs would be horrendous, even though priority dates would not necessarily need to go back further.

    However, in a sense, if the backlog is perpetual, and let's say the PD never really moves forward by more than, for example, one month, in the next 10 years (I'm picking extremes to make my point) then the effective retrogression at that point would be greater than say todays.

    Phew. Anyway, I think that's what he was on about!

    That'd happen even with or without July Fiasco. If there were 20 million people with PD in 2006, as soon as the PD in VB reaches 2006, that many people will apply, and the PD will be stuck there forever. So, what my point is, July Fiasco made NO DIFFERENCE to retrogression (except the effect of some resources at USCIS spent on receipting/issuing EAD&AP).

    I agree it's very bad, and we need to fight it. But I just didn't want to people panic on something that's un-true. I'm tired of the FUD, that's it!! Just see, now in another thread somebody is speculating about discrimination against Indians inside USCIS!!

    EB3 (I) have been hit hard there should be some effort to get the ball rolling, and I fail to understand why EB2 (I) should get offensive about this effort. EB2 is going to get what they get anyway, but EB3 guys might get somewhere if this kind of concentrated effort is made.

    I beleive EB2 will not be affected by this effort, if we draw enough attention we all EBs will get our GC sooner than later.

    PS : I work with one of best semiconductor companies in world and earn decent salary .
    All GULTIs , start giving me red and i don't give a** for that.

    I understand the pain of dependents. My son is also will be aging out.

    Ability to work comes from EAD which would come from filing of 485. July 2007 filing was pushed mainly by IV and only then other organizations have pushed for it. I hope you are aware of this. 2 year EAD is IV's achievement.

    All this happenned due to IV members and dedicated IV core. The president of this site IV is not a GULTI, but an Indian who donated about 60,000.00 US dollars. Yes, US $ 60K. He is also just like you and me. Never thought of divisions among immigrants: Neither Indian, Chinese, Philippines nor any origin. We have members from all over the world. The majority unfortunately is from India due to severe retrogression.

    Had president of IV not donated 60,000.00, majority of us would still be struggling for spouse to work.

    Please read IV's goals. Then you can comment whatever you want. Without funds, nothing can be moved. We have to lobby. That is the only option we have. IV core is also like you and me with normal jobs. They can not fly to DC every week or month for lobbying.

    Please think before posting some thing.

    I am not part of core, but have symtahies on them for doing a THANKLESS job for every one's good.

    Do you mean 30 credits with 3 year degree from India to complete MS?
    $15K for 30 credits means $500 for 1 credit?

    I did online MS degree and it took 3 years, although I could have completed it in 2.5 years. First year I completed only 1 course per sem, then I started doing 2 per sem. I took non-thesis option and the total cost was aprx 15K from ISU. Thye charge flat rate fee per subject ( aprx 3 credits) irrespective of residency requirements (you can actually do this course from anywhere in the world and it would cost the same) . This degree requires 30 total credits (one of them must be a project, so technically only 9 subjects/courses to take).

    I was about to send the e-mail and then I decided to clarify this before jumping on to it.
    I am not sure if I am asking the right question, but I am just curious what is the point in sending same e-mails to the editor of the newspaper ? From my experience in talking to them, they seems to be looking for issues and when you have something valid they print. Also a single e-mail from IV talking about us (on behalf of 6000 of us) and the issues we are facing would have sufficed ? Right ? or I am missing something ? I know e-mail as faxes work for political campaign to show numbers but not seen it in news media ?

    Any idea how many emails news media outlets recieve? Do you remember the emails Jim Carey reads in Bruce Almighty? he hee .. Some thing of that sort, if not of that magnitude. By sending more emails, we are making the media cognizant of the fact that its not one person but hundreds of thousands of people. Also, these emails are mostly read by interns and they sort them( In big outlets atleast) The more the emails on same issue from diff people with diff body with same bottom line story gives us a better chance. Do I make sense?

    I guess country quota is root of all our green card related griefs. everybody else can dream of getting a green card someday, but EB-3/EB-2 India & China should stop dreaming about Green cards...I am sure this can be prooved illegal.

    We cant say. Even Supreme Court works by voting where judges vote and majority wins.
    In the past courts has said yes to "Affirmative action" and that it doesn't violate the
    equality given by constitution.

    Another option would be to challenge the interpretation of the law. Like unused visa capture whether wasted visa
    should be counted.

    Long back time spent outside US and on H4 visa used to we wasted. Not anymore. This has come about by challenging
    the interpretation of the law.

    Similar challenges are going on interpretation of the Child status protection act that was passed in 2002

    IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).

    This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.

    Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.

    Bottomline, do not underestimate America. They know what they do.

    I share your thoughts. There are a multitude of sectors/issues that are mimicking the American style. With the advent of ICICI, any body can pretty much walk in and get a loan with a 30 yr EMI. Imagine the number of people losing jobs in India, both at Multinational and local companies providing services if the economy tanks here. What are people gonna do with home loans they signed up for 30 yrs or what ever? Fore closures on a grand scale?? Indian economy has been going up.. up and up due to software services and BPO sector. With out any manufacturing, infrastructure building up it would be very difficult for Indian economy to sustain growth or level out gracefully when hit hard. IMHO, Just being the back office of the world will not get India on par with US.

    Should watch AILA's stand on this. One group who would benefit immensely with this system would be immi lawyers, at least for first 10 years after which it would be more established. A perfectly intelligent delaying technique moving the issue away from its solution at least by 2 full years. This idea appears to be so full of holes, it seems as though coming from WH itself. Soemtime Logiclife nicely argued against such a suggestion, it would help to dig out those comments and post them here...

    on the contrary, the point based system completely eliminates the need of a lawyer, with the canadian and australian system u just need to do the work urself online and the balls starts rolling then, it'll be interesting how they react to this

    Employment Based (EB) Green Card (GC) Numbers Situation

    The yearly EB GC quota is 140K. This includes visas for spouses and children. On an average, it is given to ~ 60K families.
    Each country is allocated 7% (of 140K) GCs with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Each country gets approximately 9800 GCs (~4K families).
    The Ombudsman estimates submission of 500K-750K (yes 500K) AOS applications between June 1 and August 17 2007. Most of these applications will be from India and China.
    According to Ombudsman's 2007 report, there were ~1M AOS applications pending as of March’07.
    So far EAD renewal has been taking ?? months. With the additional applications it will take ?? months and we will have to apply for renewal after ?? months.
    The security check backlog appears likely to get worse, if a new immigration bill is enacted as millions of undocumented immigrants would also apply for legalization.
    If you were unmarried at the time of filing, you will need to continue on current status (e.g. H-1B) otherwise you cannot bring your spouse.
    USCIS is a self-funded organization i.e. it runs on fees it receives and is short on resources.


    What do these numbers mean?

    There will be 1.4M+ AOS applications by Aug 17 which will take 1.4M/140K = 10+ years. That is, priority dates (PD) will remain retrogressed for several years.
    Those who could not file their I-485 now will now have to waitttttt…..
    Due to resource constraints, security checks may take years.
    Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
    Endless cycle of EAD renewals and Advance paroles.
    If working on EAD and for any reason, if any of your EAD gets rejected, you will need to stop working, In other words, need to leave your job.
    You need to be in the same position with same job responsibilities for an indefinite time period otherwise you Green Card application will be rejected.
    EADs are valid for one year and several employers (and rightly so) view it as a temporary permit and hence reluctant to hire you.
    Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
    So virtually you have three options: a) Struggle for several years b) Leave the USA c) Join us.

    Legislative Efforts

    EB Immigration reforms do not find enough support on the senate floors (Failure of SKIL, STEM etc Bills). As a matter of fact, it does not even get enough support to make it debatable, let alone final voting on the bills.
    IV grassroot effort (flower campaign and SJ rally) was a very important reason for retraction of July Visa Bulletin.

    My wife is has a bachelor's degree in Computer Science. She is on H4..She is at present pursuing her MS in Comp Sc..She would complete it next May..That degree is costing me a hand and a foot...
    After that she is gonna start looking for a job...But the way the H1 caps are filling these days..I am not sure what would happen..

    It is created to sharing ideas among members - to resolve immigration matters - not to discuss other topics like real estate investments etc. It is okay to quote one's or someone else's progress in financial matters in the context of his/her immigration status, but to make a complete turn and just discuss the specifics of financial investments etc. doesn't have a place on this forum.

    I don't agree with you.

    While we are waiting for GC,What options we have in US ? How to use our time more effectively instead of worrying too much ? This is what we were discussiing. It is indirectly related to immigration.

    Take it easy Man.....Don't worry too much about the content !
