This is a town-hall meeting organized by Congressman Gutierrez (Sponsor of STRIVE ACT) in San Jose, CA on Saturday April 21st at 4:00 PM.

To stand in support of STRIVE act of 2007 and thereby support title 5 of high-skills legal immigration. It is very important for Immigration Voice to show up in large number so that we can project our strength and also confirm our support to the congressman and thank him for working to reform the broken system by including provisions to remove skilled-immigration backlog. You can also ask questions during the Q&A to Congressman Gutierrez.
Pratik will be attending this with many other members of IV in San Jose and Bay area including a couple of other core group members. There is 500 character limit on the white house web site. I just send simple message saying that USCIS has wasted lot of visas in the earliers due to inefficiency and that they should be recaputred. And that it is causing lot of hardship to well educated people who are here legally.
Sometimes I send a different message (which agrees with new presidents policy about FOIA), I ask the president to get USCIS to disclose pending applications per year per category per country.

My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.
As per USPS online tracking record it was delivered July 2nd 12.45 PM.
No receipt yet. So far sounds okay.
But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.
It is a stamp so some of their employee clearly has stamped it.
Now I am confused if that’s the receipt date they are going to go with and may reject the application.
And with this many application it may take more than AUG 17th to receive anything back.
I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.
And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.
Anybody in the same situation? Any advice?

If you call it re-distribution of pain, I would call it sharing the pain. I think its high time ROW candidates felt the pain which we non-ROW have suffered for a long time. You are objecting just because you are on the better side and wish to continue with the better bargain. If you think about it as a EB group in general, then its absolutely ridiculous that there should be country limits for EB category GC when there is no limits on H1B which is the primary route for most EB category GC applications. I completely agree with you on the family quotient of your arguement, they should not get the GC numbers which is meant only for primary EB applicant. Not that I want families to suffer, but the family GC numbers for EB applicants should not count towards GC number cap.

Both 1A and 2A category for Family Based (sons, daughters, spouse - of citizens and green card holders) has better dates (15th Aug 02, 15th Aug 2004) than EB-2 India, and EB-3 India.
This is so preposterous, words cannot even begin to describe this absurdity.
So those of us who have been in U.S. for almost a decade, have been contributing to this society, and have held our life in constant limbo, are being given a lower priority than those who are still back in their own country and living a happy life and who can now immigrate to U.S. based on family immigration.
Do the lawmakers have no common sense left atall??
Check my threads on Citizenship. Ask for citizenship directly if you are living here for more than a decade...

I got a reply from USCIS saying that they can process the request sorted by priority date and country of birth of the applicant. Processing time will be around 15 months and that they have got their answer on priority date.

frankly personal attacks and strong language are not going to get anyone's point across any better. try keeping a cool approach and write well reasoned thoughtful posts. also don't forget, in everything, there is ususally something to the other point of view- however much we disagree on something. lets try this refreshing new approach...maybe we will find there is actually common ground...;)

The mystery is solved. I have corresponded with Charlie Oppenheim in the Visa Office. He confirmed that the 27% limit does apply. He explained that during this fiscal year, the CIS consumed an unusually large number of Indian EB2 visas, thus making the category unavailable despite a retrogression in the cuoff date which was intended to hold number use within the limit.
He said that based on his discussions with the CIS, he was informed that the CIS did not feel that the current amount of pending Indian first preference demand would be insufficient to use all available numbers under the limit. Therefore, he allowed some of those numbers to fall down into Indian second preference.
So, the Indian second preference numbers used to establish a cutoff date for April are coming from left over Indian first preference, not worldwide numbers.

It is just not desi compaanies, but small companies in general want to save every peenny and would like to extract more work and would not mind about ur status or legality but will just get their work done.
When you join desi company you have to deal with crap. Must be very careful while inbetween projects and make sure u don't accrue any bench time.

I dont think legally you can sue someone, because they have worked harder.
I posted this link , so that everybody may know the legal reasons, which we can present in a court of law.
If this lawsuit is accepted by the court , then the USCIS lawyers would tell what exactly happened.
I till now personally believe , that the USCIS/DOS hasnt broken any law.
They may have however changed a pettern,process , but no law has been broken.
It took them 6 months to consume 66K visas and then another 15 days to process another 66K.
It is reasonably safe to assume, either correct procedures were not followed in the past or were not followed in the last 2 weeks. Only a judge can order USCIS to elobarte on what processes were followed in the last 2 weeks (FBI name checks and security clearances skipped...etc. etc.)
They made people expend (or rather waste) millions of dollars in preparing the paperwork...and then changed the process abruptly on July 2nd..with no advance notice...they could have published a guidance in the July bulletin itself of this possibly happening, if not published a guidance sometime later...
There is no doubt, that the entire chain of events were premeditated...and the communication mix-up as claimed by Condoleezza Rice on TV was a deliberate one..
I doubt if this will all fly in court...they certainly owe the millions of wasted dollars and thousands of wasted hours in preparing the paperwork, back to the applicants/attornies...at the least...
Keep in mind, the AILF rarely files a law suit against the government, and most of their law suits have had favorable outcomes..

This is what I felt. When folks from CA could turn out in such a big number, what stopped DC Metro area and NYC/NJ Area folks to come? Perhaps they do not deserve Capital so close to them. What else it is for? To take their friends and relatives there for photo taking? This is what I felt.
Over all, one of the most fulfilling three days of my life. I learnt what is law making in this country and how things work.
