    Service industry is not always based on labor cost differentials. Many services are value added services. For example, stock brokers used to charge $200 and above for stock trades; however, electronic brokers came and made the industry efficient and hence can profit more by charging only $10 or even less. But this does not mean that the stock brokers are earning less. In fact they are earning more than before. However, their value additions come from faster settlement times and high volumes. This is easier to analyze. Now look at London or Hong Kong -- what services it provides and why is it booming?

    High investments in R&D in general is good for economy but not necessarily true for a company. For example, German manufacturers are best R&D shops; however, their over investment in precision is precisely their problem. On the other hand Apple copied mp3 music players from Creative and made millions. One can find countless examples of skilled marketing (services) not innovative products making money. So don't assume that R&D investments are always good for a company.

    Finally, Wipro & the likes -- they have already opened up shops in China, Mexico, Brazil (yes)... and finally if dollar falls further they could actually buy the US companies and make them efficient (Honda and GM example).


    As long as quick money can be invested into wise investments, it can be safe. But do remember, to build anything from scratch is a pain, but to manage and service it is easy. All the easy money, if invested in long term growth will be very benefitial to humanity

    This thread seems to express my thoughts.
    I used to wait till my dates got current. With my dates being current since November, I still wait with no sign of improvement.
    I tried calling the 1-800 number. But, did not get any useful information.
    Took an Infopass appointment couple of weeks back. But, it was of no use.
    The officer at the local office read the same status that I see online.
    She said that my case was transfered to Texas center. (I knew this since October 2007). Only additional information she gave me was that my namecheck got clreared. (Though this is important, I dont think this really matters to get my case processed).

    I told her that I have been waiting since years and some of friends who filed later than me already got their GCs, she felt sorry for me but she said there is nothing she can do for me. Not even a Service Request since my dates are within the processing times.

    Its getting difficult for me......Also, in this economy its getting tough everyday to hold on to the job. Who knows may be this year quota might be over too. It will definitely be a big relief if we get the GC.
    I thought there is nothing I can do now till my dates goes outside the processing times. Please advice.

    Since your situation is aggravated, your wife can apply for F1 visa and come here. How you want to answer visa questions on DS-156 or date your marriage cert is upto you. But all said and done and whatever the morale police on this board have recommended is not really valid because you will be going through all of this and not these people who are giving other suggestions. I really want to ask all these people who say dont backdate marriage cert or dont get her on F1, are you guys angels and have done nothing wrong in your lives or are you just preaching others not to sin?

    We need to call for unity ask people to come out and support this initiative.
    We got to do somthing. Enough is enough. Think of all high skilled workers not going to work for a day what kind of impact that will have? What kind of awareness that will create? I am ready to give up one day worth of pay for this. Anyone else?

    Efforts have to be collective. Try to get supporrt from coworkers, friends - ask them for a honest opinion and see what they have to say

    Today, four members of IV met with 3 staffers from Dianne Feinstein’s office in San Francisco.
    Two constituent services representatives, who deal with immigration problems on a daily basis (helping people with labor cert, I-140, I-485, security check etc problems) and one assistant field representative who interfaces with the Senator’s staff in DC on a whole host of issues.

    We spent 1.5 hours with them. We went through our presentation, answering questions and giving examples all the way. Then we spent some time talking about how they could help us, suggestions about what IV should do, and how we could work with them. All in all it was an excellent meeting – they were riveted through out – asked lots of questions and were very supportive.

    TAKEAWAYS

    1.Getting the Word Out to Lawmakers

    • They all said they learned a lot from our presentation – the people who deal with immigration problems on a nitty gritty daily level didn’t know the big picture on legal immigration, and the field representative didn’t know anything about the particular problems of legal EB immigrants.
    • The field representative said she had had three meeting with immigration related groups that day already, and that the Senator’s staff has been hearing about immigration a lot BUT this was the first time she was hearing about legal skilled immigrants!!
    • They thought our goals were reasonable and that they would be supportive. They thought we should reach out to as many other lawmakers as possible

    BOTTOM LINE: Do you want favorable legislation not to pass simply because people didn’t know about our problems??? No! We need to get the word out.

    2.Content

    • They repeatedly said they were impressed with our presentation (go check it out).
    • They liked the fact that we had an easy to read table which showed which of the current bills addressed some of our goals.
    • They liked the fact that we printed and bound two copies of the presentation to give them.
    • We also gave them copies of our tri-fold brochure

    • We decided to keep in touch – I will follow up on the feedback they get from the Senator’s DC staffers.
    • They wanted to know more about how our meetings with other lawmakers are going.
    • I offered to act as source of facts and examples for their office on these issues – since I have read the relevant documents and data carefully.
    • They suggested that we keep reaching out to members of the House – especially those who are in states without a lot of tech sector firms – those are the people who are least likely to know about our existence, let alone our problems.

    BOTTOM LINE: I will keep in touch with all three, sharing talking points and getting feedback.

    4. Lessons for future meetings with lawmakers/ Lessons for other states
    • Do not be intimidated by the idea of initiating a meeting with the staffers of lawmaker – they do this all the time, and are friendly, easy to talk to, it is their job to listen to you– just put yourselves in the mindset of someone telling a story to a friendly audience.
    • Get organized, print and bind copies of the presentation and additional docs listed above to give to them.
    • Do a dry run of the talk, so that you build a narrative patter to go with the slides – this worked really well in this meeting.
    • Whenever possible use examples from the experience of the IV members present to illustrate the point in the slide – for example when we were doing the I-485 Life with and Without Slide, we used Ollie and Neha’s experiences with layoffs and partner not being able to work
    • Ask how you can follow up with them, what they would like you to do
    • Write to thank them for their time and reiterate your basic points

    It does not matter who will get credit for this. It would not happen without people taking action - IV members or those who took the USCIS to court (BTW, 90% of those did it without attorneys). Nothing happens if you do not do anything!

    According to my own experience, all is about credit histories and credit scores. If you have not lived long enough in the US (3 years or more might be enough), you don't have a credit history or you have one but it is insufficient, and financial institutions, mortgage companies, car insurance companies, etc, don't know you, consequently, everything is expensive for you: high car insurance premiums, high mortgage rates, high premium for homeowner insurance...if only they except to do business with you. (By the way, I was denied a credit card, a car insurance...when I first moved to Arizona in 2001; fortunately I was able to keep using anything that was Canadian: car and car insurance, credit card, bank account, etc.). Otherwise you are denied everything. I am talking about my own experience as Canadian Citizen working in the US under H1-B before 9/11 event. It must be harder nowadays.
    Now financial institutions know me, I receive tons and tons of credit card and mortgage offers...and I had to go to this website https://www.optoutprescreen.com/?rf=tto opt-out, so I don't get those ads anymore.
    So you're alone in these disadvantageous financial situations.

    E-filed on May 5th, FP on June 6th, no updates since. Concerned as I'm working on EAD and current one expires August 29th.

    Paper filed AP in late June, approved already (as per e-mail) even though I only needed it in mid October!!

    If the total number of visas available under paragraph (1), (2), (3), (4), or (5).



    You might have to define what the word "is" is ;-)

    Anyway, that paragraph also states: "If the total number of visas available under paragraph (1), (2), (3), (4), or (5) [...] exceeds the number of qualified immigrants who may otherwise issued such visas,." but then continues on with: "the visas made available under that paragraph shall be issued without regard to the numerical limitation"

    One could interpret this distinction such that the actual number of visas available is not necessarily the same number of visas made available, which is fixed to 28.6% + spill-over. It might, as well, comprise only those unused visas that haven't been passed down to a lower category. 203 (b) (2) / (3) and 202(5) seem to compete over the unused numbers. Not sure which one has preference.


    This is the very direct, simple interpretation of 202 5 A.
    Therefore one cannot (EB3-ROW) interpret, for their convenience.


    Well, that's according to your interpretation. You seem to suggest that USCIS disagrees with your interpretation. We probably have to wait for the next immigration statistics to see what rule USCIS has been following.


    Thats why I suggest the IV to discuss with experinced attorney and make a enquiry with law makers or DOS, if required. Otherwise (if it is wrong it is a big blow to India and China). We will get only 2800 per year.

    I'd hope IV would focus on increasing the number of GCs available to all of us, instead of fighting for allocation. ACT-21 increased the number of H1B visas without increasing the number of GCs.
