Reading the article I see that Neelima is, in fact, a US citizen of indian origin; not even an H1-B or GC. So lesson for us - getting a GC may be a convenience for us, but we are naive to think our troubles will end with it.Red neckers of the likes of Loo and his cronies arent suddenly going to accept us as one of them - rather, this is a life long struggle of the kind the african americans had to go through for centuries (and to some extent are still going through). Only wish ABCDs like Ron Hira realize that as well.

What do you mean by upgrade to premium? I dont think you can change the option by simply upgrading. You need to file I-864 to change to consular processing.
There are a few options:
1. If you have chosen consular processing, ( I am guessing you have not), you can file I-485 and amended I-140 at any time PD becomes current.
2. If you chose AOS on I-140 and the I-140 is approved, some consulates accept attorney certified I-140 provided you pay the fees usually payable to NVC. Expect 3 months of delay in getting an appointment though.
Pros & Cons:
Consular:
You get your GC as against EADs endless loop.
You have to be with the same employer for atleast 180 days since the time you get your GC and you enter US using your GC.
AOS:
You and your spouse both get EAD. NO need to travel to foreign country.
You need to wait 180 days from filing 485 to change jobs (assuming 140 is approved, if not the case is more complicated).
More time consuming and longer duration.
The lawyers here will vouch for I-485 as it means more revenue for them. If you have a stable job where you are doing good and you are counting to get a promotion, etc go for consular processing instead of getting stuck with 485 process.

2) Dress properly - get a haircut and dont use cooking oil instead of gel. Get rid of the moustache if you have one. Make sure you dont stink. Dressing up smartly elevates your image - remember this country is very image conscious - which I think it should be. Dressing nicely and smelling good will not hurt anybody. actually, lets make another category 3.c. people who have shifted jobs after ead using AC21 and now want to or already have started a company for side business (that may be in the labor/perm cert job description or outside)...
So, I am 3.c. and so is perhaps matreen... after digesting my conversation with the lawyer for two three days now, i am feeling that it might be worth taking the risk of doing a side business. after all, we are not doing anything that is uncivil or criminal... just trying to boost our incomes and perhaps contribute to an industry or something like that... that noble intention could be viewed as an exclusive intention in relation to the intention to continue permanent employment with the new GC sponsoring employer... what do you guys think?

Although you have used AC21, you are still working on a job that is as per the Labor Certification (if not, then you have bigger problems as AC21 can only be used for same/similar jobs). 3 c. *might* add a level of complexity for your case, but I think you should be fine. But again, we should cross the bridge when we get there and as long as we are doing something legal, we should be fine even though it might be a grey area. Being future entrepreneurs, we need to get accustomed to taking risks :)

Don't worry about this bill being rejected. I am pretty sure one way or the other they need to increase the EB visa number soon, else definetely USCIS will be in big trouble with thousands of applications sitting there for them, now having said that USCIS will find a way to get some bill which will have EB visa count increased passed in congress, so untill then cheer up and complete your filing.:) :) :)

You dont need an EAD, if you still have valid H1. AC21 has nothing to do with EAD. However, if your H1 is expiring soon, and you have already used up 6 years of H1, you would need an EAD, because H1 extension beyond 6 years is available only for people who cant file I485 because of retrogression.

I'm hoping to get a receipt notice soon so that i can file for EAD without the increased fees. Anybody has any link to where it says we don't need EAD for AC21 so i can check with my lawyer?

1) You need to determine sufficient coverage. If you have a mortgage and children, $500K is the minimum. A 30 year term non-smoker age 35+ should be about $350/year. You usually get a discount if you buy a policy for your wife too. If you try to purchase a whole life for $500K coverage, the premium will be ridiculous...probably $1500 to $2K/year.
2) I always remind myself of the KISS rule (Keep it simple stupid). If you want protection buy term insurance, if you want to save/invest buy stocks, mutual funds, bonds, etc. Don't try to mix them.
3) To protect your familiy, think of the 3 areas: Death, disability and illness. Dying is the easy part...you die, your family gets a lump sum. The worst is that you DON'T die, but have a terminal illness (e.g. cancer), have no job and then incur substantial medical bills. Remember to cover all areas.

maybe some day in the not too distant future, when the days of bonded H-1b labor end, a person who has lost time and passed up opportunites can actually go to a court and sue DOL and USCIS for damages and opportunity costs.

AND ONE MORE THING. THESE PROCESSING DATES ARE FOR RENEWAL APPLICATIONS. NOT FOR NEW APPLICATIONS. FROM MY EXPERIENCE I SAW FIRST TIME FILERS ARE GETTING THEM IMMEDIATELY THAN RENEWALS WHICH WERE TAKING 2-3 MONTHS.
